Balance: Unbalanced

1. Introduction

In our “Irrefutable Proof” post we showed you how the listings in the Ocean Club’s Booking sheets had been doctored. They were filled with EHE – Evident Human Errors.

In what were supposed to be print outs from a database and therefore without the EHE shown.

Then we said that we had been pointed in the right direction by comments made both by Insane and Johanna.

In one of those comments Johanna said the following:

“Just one thing. As demonstrated on the example of the Hynds: the booking sheets were always kept in a weekly record. If customers stayed for 2 weeks then there would be 2 sheets given to the Tapas restaurant.

The Hynds for example stayed 2 weeks. The first booking sheet given to the Tapas restaurant gives their stay from 28/04 until 05/05 and the second booking sheet was then given to the restaurant the following week listing the Hynds as staying from 05/05 until 12/05.”

The sheets were given, apparently, on a daily basis to the Tapas Bar.

Searching the PJ Files, no such procedure is referred so we can’t ascertain the reasons for its existence. It is a fact that 4 of the 6 sets that appear on the files do have a handwritten header of “Tapas” just above the computer header “Listagem de hóspedes” (Guest list):

2. Keeping the tab

We published, untouched and exceptionally uncensored, Insane’s explanation as to why the computer totals don’t tally up with what the listings refer to in terms of number of apartments by their designations as we showed in our “Definitive Proof” post.

An excerpt of that explanation, now censored:

“So what you SHOULD have asked yourself is, ''what were these documents for?''

They were for the Tapas restaurant.

So why did they need a list? I gave you a clue yesterday.

Because the Tapas restaurant was included as a dining option for Mark Warner guests on their package. This was not the case for other companies. Did they need to know occupancy rates? No. Would they give a (censored) about how an apartment was designated? No.

The PJ took these reports along with the table bookings. They did not say ''Kindly supply us with a list of all your guests, along with occupancy rates, individual spend and the kind of detail which would bring joy to the life of an auditor'' They just took what was there.”

Insane corroborates that the lists are for the Tapas bar.

But although he does pose the question “so why did they need a list?” he offers no explanation.

We fail to see why a restaurant being included as a dining option for a certain tour operator has anything to do with being supplied a daily list with all the information about all the guests including those of other tour operators.

If, and we repeat if, the dining option for Mark Warner was the reason, shouldn’t the list contain only the information pertaining to the Mark Warner guests? But we will get to that later in the post.

Insane must have forgotten that he didn’t need to give any explanation as he had already done so. In his reaction to our “Irrefutable Proof” he says:

“Hotels and other holiday accommodation have these lists for several reasons. They will use them when people attend for meals to cross them off and check whether the meal is part of an inclusive package. Textusa has carefully deleted the last column which is labelled ''Saldo''

Do you know what ''Saldo'' means?

It means ''Balance''. It's a running total of charges accumulated by the guest which they have charged to their account.

These reports are run off on a daily basis, usually after the bar has shut and all the tabs have been rung in. It's not a difficult concept.

The records are frequently accessed. Keying errors and typos mean mistakes will sometimes appear.

And that, basically, is that.”

So it’s all about the tabs. Note that at this stage for Insane the discrepancies were due to “keying errors and typos”. Nothing about OCR. That passion would only appear later, it seems.

We do find it strange that in no booking sheet is there anything that resembles any sort of checking done by the Tapas staff about Mark Warner guests.

Plus, not all Mark Warner guests were entitled to have dinner at Tapas, only the abnegated ones willing to stand in a queue early in the morning plus the favoured by unexplained nepotism. All others had to eat at the Millenium or if they were willing to pay and forfeit what the package offered, eat somewhere else.

Shouldn’t there be a check mark of some sort next to the names of the privileged? There aren’t any such marking.

Another blogger concurs with Insane on the keeping the tab being the reason why Tapas received daily a list of all clients at the resort and their respective details:

“The issue starts with the PJ files. The link above describes the documents as check-in lists used by the Tapas restaurant. This is wrong. The prints are running tabs of what customers owe to the Tapas area, presumably so this can be paid at check-out.”

This blogger is more generic, as he says it’s about what customers, and not only the Mark Warner guest, owed to the Tapas area, not only restaurant.

So these lists, apparently, are all about the money.

3. Booking sheets

The last column of booking sheets (“Saldo”) clearly refers to expenses, to be more specific, any unsettled guest bills to the OC.

Anyone familiar with hotels can tell you these refer to anything, from unsettled room bills – these are paid on checkout if a direct booking – to dinners and drinks in the restaurants (Millennium, Tapas, and Adult pools) or room service and mini bar, extras like microwaves, travel cots, baby pushchairs/strollers, babysitting (if they opted for the nanny service in the room at night), Spa treatments and other services that a guest has to pay for outside package offered.

These listings could never be for the Tapas bar to check the guest expenses since these expenses are for all facilities and services available in the complex.

There are no subtotals. Much less one for Tapas.

Moreover the Tapas bar is not for the exclusive use of Mark Warner, as seems to be wrongly assumed by many.

It is for all the guests, on half board, full board, bed & breakfast only or just accommodation.

The variations are immense.

The only accounts Tapas need is the cash used to pay bills and an apartment number easily checked on system by either manually entering apartment number or by a swipe card to charge expenses to the room.

Client gets a receipt, signs and keeps a copy.

Amount shown in “Listagem de hóspedes” (Guest list) is for the central system to deal with ALL information pertaining to guests and/or owners.

Why the document has the handwritten word Tapas on it is a mystery which we will deal with later in the post but one can CLEARLY see from the title the list is called "Guest List" not Tapas bar guest list.

And there’s no evidence of any query to single out Tapas or any Mark Warner guests in its listings.

Did all Ocean Club facilities get daily a complete list of all guests? The Millenium pool bar and restaurant (or were these 2 separate listings?), the Adult pool bar, the reception (to keep a tab on baby strollers and travel cots), the Spa, the Childcare and whoever supplied extras to customers?

A daily listing with no respective subtotal?

As can be easily seen these sheets are not created or for the use of Tapas bar.

Why on earth would the Tapas bar need the amount paid for accommodation?

Why on earth would Tapas bar staff need to know any other information about all other expenditures a guest may have had? Isn’t that clearly a breach of the most basic confidentiality?

4.  Amounts

But let’s set reason aside for a moment. Let’s imagine there is some insane reason for Tapas to have been given these sheets.

That reason can only be due to the amounts expressed on the right-hand column, or “Saldo”.

The column Insane has accused us of hiding away from readers.

Let’s once again abide by Insane’s wishes and look at that column attentively.

5. Colours

To facilitate the visualisation of the information contained in the 24 pages in question we will use the same colour scheme we used on our  “Irrefutable Proof” and “Definitive Proof” posts:

This way the reader will be able to understand where the information comes from that we are presenting. For example, anything with a blue background is from pages 623 to 626 (May 4 01:48) and if yellow it will be from pages 631 to 634 (May 6 07:05).

We will now look at what, on each of these days, is listed as occupied apartments. We warn it will be repetitive but it has to be that way as the reader will hopefully realise.

As in our “Definitive Proof” we will analyse each set of 4 pages separately. This done we will collate and sum up (#12. Significant and evident difference in numbers) all relevant information from the 6 sets.

6. Listings of pages 615-618 (May 1 2007 03:45)

table at the bottom of page 618

Above is a summary table showing the addition of the information from pages 615 to 618 by its various categories including that of  “Saldo” (Balance).

On looking at pages 615, 616, 617 and 618 more attentively one can see:

(i) All amounts from all T1 apartments listed had a balance of 1 569,40 €:

BARBER (41,00 €), BENTON (4,00 €), BRAIN (151,00 €), BULLEN (34,20 €), BURLTON (29,50 €), CAIRNS 68,80 €), CARPENTER (164,50 €), COX (12,00 €), HALLAM (71,50 €), HARDING (6,00 €), IRWIN (1,60 €), JENSEN (540,00 €), KNAGGS (44,50 €), MANN (3,00 €), MILLS (81,80 €), NEWMAN (17,00 €), O'DONNEL (32,25 €), OBRIEN (105,00 €), OLDFIELD (21,00 €), PATEL (17,00 €), PLANE (23,00 €), SCHARFENBERG (50,00 €), SPERREY (20,25 €), TAYLOR (5,00 €) and THORNHILL (25,50 €).

(ii) All amounts from all T2 apartments listed had a balance of 990,20 €:

BERRY (116,50 €), CLIFFORD (40,00 €), EDMONDS (33,00 €), GORROD (10,50 €), HILLS (65,50 €), HYND (56,20 €), JANCZUR (21,00 €), MCCORMICK (13,00 €), McCANN (242,00 €), NAYLOR (99,00 €), PAYNE (117,50 €), SPEIRS (32,50 €), TOTMAN (33,00 €), WEINBURGER (70,50 €) and WILLIAMS (40,00 €).

(ii) All amounts from all T3F apartments listed had a balance of 1 591,20 €:

BOOKER-MILBURN (1 591,20 €).

(iii) An apartment with designation not listed, TZ, had a balance of 30,00 €:

TAVERNER (30,00 €).

(iv) All other types of apartments listed had no balance.

However the summary table for those pages states the following:

Comparison between the table at bottom of page 618 (what computer added) and what was listed in sheets:

As can be seen, even though the totals obtained from the table and sheets are identical there are EVIDENT discrepancies in the balances referred to in what is a same document for the T1, T2, T3F, T3FP and T3FB apartments.

Only the apartments with no balance, T3 and T4, match between values accounted for in the table and what is expressed in the sheets.

Interesting to see the table stating that the T3FP apartments had a balance of 17,00 € but sheets do not show it.

On the other hand the sheets show a 30,00 € balance for the TZ apartment which is not even listed on the table.

Then we have the “interaction” between the T3F and T3FB apartments. Both have the same 1 591,20 € as balance but it shows up for one on the table and for the other on the sheets.

It begs the question:

7. Listings of pages 619-622 (May 3 2007 01:16)

(ii) All amounts from all T3F apartments listed had a balance of 1 591,20 €:
BERRY (177,00 €), CLIFFORD (58,50 €), EDMONDS (86,10 €), GORROD (10,50 €), HILLS (65,50 €), HYND (98,20 €), JANCZUR (38,00 €), MCCORMICK (22,00 €), McCANN (242,00 €), NAYLOR (110,40 €), PAYNE (162,00 €), SPEIRS (32,50 €), TOTMAN (33,00 €), WEINBURGER (106,50 €) and WILLIAMS (43,50 €).

(ii) All amounts from all T3F apartments listed had a balance of 1 591,20 €:

BOOKER-MILBURN (1 591,20 €).

(iii) All apartments T3, T4 and T3FP listed had no balance.

However the summary table for those pages states the following:

Comparison between the table at bottom of page 622 (what computer counted) and what was listed in sheets:

As can be seen there are EVIDENT discrepancies in the balances referred to in the same document for the T1, T2, T3F and T3FB apartments.

We have the “interaction” between the T3F and T3FB apartments. Both have the same 1 591,20 € as balance but it shows up for one on the table and for the other on the sheets.

In this set of 4 pages, not even the totals match. There's a difference of 20,00 €

It begs the question:

It begs the question:

12. Significant and evident difference in numbers

The 6 tables shown above:

The summary of the daily differences between the listings and respective table for all 24 pages:

In red, when there were more apartments occupied on the listing than there were on the table. Background blue represents the only times numbers between table and sheets match.

If the intention was to inform anyone about balances then these were certainly not the best documents to that end.

Too many “mistakes” to be accidental.

And in this case detractors cannot resort to “OCR mistakes” because this adding process occurs independently of any sort of character conversion.

A computer does not make mistakes in adding.

It's EHE. Evident Human Error.

13. The significance of handwriting

The fact that these sheets were doctored is evident and undeniable.

But there’s one detail that aggravates this doctoring even further. The handwritten “Tapas” header.

As we have said, 4 out of the 6 sets have that handwritten header:

Note the repetition in the 4/2 break in continuity as we also saw it in the Tapas Reservation sheets. First 4 days one sort of presentation, the other 2, another.

Before we get to what we think is the reason for this header, shouldn’t we now repeat the question: where is the May 02 set?

Notice its the same person who writes “Tapas” and “Terça-feira” (Tuesday), “Quinta-feira” (Thursday), “Sexta-feira” (Friday) and “Sabado” (Saturday). Shouldn't this same person notice that Wednesday was missing? And just have gone back to binder and complete the information?

No one writes the days of the week without noticing they're skipping one.

Note the handwriting is different from the one in the other 2 sets. It means clearly the first 4 sets were done to “help” the PJ in identifying what each set of papers meant.

We think “Listagem de hóspedes” (Guest list) would be sufficient for the PJ to know what the listings were about so why the need to place the “Tapas”, when we have seen it has nothing to do with the place?

It is about the intent to bring attention to Tapas and Tapas only. To circumscribe events to Apartment 5A, Tapas area (restaurant, tennis courts and Toddlers clubs) and Crèche.

The rest of the Ocean Club, namely the Adult and Indoor pools are blurred completely out of the picture.

Why is the word “Adult” crossed out:

Why so much typexing in this header. Why do the “D” and “Ref” column headers appear not aligned horizontally with the other headers and printed over a typex?

As we said in our “Definitive Proof” post, to doctor these sheets the way they were took time, personnel and intention.

The clear intention to mislead.

14. Conclusion

We repeat, the circle of those involved directly in situ with covering up what had happened with Maddie was much wider than the T9.

To go after the McCanns and the rest of the T7 is easy.

To fight those who really are keeping the lid on the truth, is a whole different game altogether.

But either one wants to know the truth or one doesn't.

There are 2 ways to look at an elephant in a room. One is to ask what is such an animal doing in such an odd place and seek an answer to that question, the other is to say, no, an elephant cannot be in the room, so that elephant is not an elephant.

Neither attitude changes one thing: that elephant is an elephant and will continue to be an elephant.

To win a battle with an army of one is much more gratifying than to win it with one made up of battalions, regiments and divisions.

To win the war with such an army is sublime.

And we aren't an army of one. Neither of three. Far from that.

POST SCRIPTUM:

We would like to tackle a few issues very briefly:

PS.1. “OCR mythology”

As we explained in our last post, OCR was not used when reproducing files.

However, someone, not innocently, has come up with a wonder version of OCR:

“Textusa has come back in today’s post to say that these cannot be OCR errors for a number of reasons. For example, there is handwriting on the sheets and OCR does not leave handwriting on a sheet. It converts it to text, whether such text is clear or garbled.

I am not interested in going into a point by point examination of this stance. It gets us nowhere. The software I have used takes text of the type entering your eyeballs right now, and tries to tidy it up to a recognised word. When the OCR software hits what looks like non-text, it renders it as an image. So images look like images, handwriting looks like an image, and text gets tidied up. But none of this is important.”

OCR may we remind you, stands for Optical Character Recognition. Its acronym has quite clear and explicitly 2 words: Character and Recognition.

As if asked by us, Anonymous 11 May 2015, 17:01:00 in a comment to our “Definitive Proof” post gave us a link, here, that shows the practical use of OCR.

It's the phone listings provided by Vodafone that were OCR’d, says Anon, by Jean d’Arc.

As can be seen, it’s filled with nonsensical spelling mistakes. In just the sample below, 12 mistakes. There are thousands of them in the 195 pages that were converted:

A frequency which is not what is found in Booking sheets.

This is what OCR does when it encounters a picture. It converts into characters:

Or, when encountering something it can’t recognise, it converts into a garbled set of characters that don’t make any sort of sense:

And when it can’t recognise anything, it ignores it and produces nothing:

Or as Insane so correctly puts it:

“OCR can't scan them [handwritten annotations] and resolve them into text so it will ignore them.”

No OCR accounts for the discrepancies found in the Booking sheets.

It’s evident that it’s doctoring. Sometimes truth is so evident that even Insane has to recognise it.

And it's very important the difference between an error that can be explained by software, which is not the case, and the human interference in information handed over to the authorities in the course of an investigation, which is the case.

PS.2. Apartment counting

This is what Insane has to say about the fact that the computer did not count correctly the “T” it has listed:

“Seriously - an apartment is mis-coded as a T1 when it should be a T2 and you conclude that this means there was a huge, swinging conspiracy going on??”

The question is not whether apartments were “mis-coded” or not.

The question is that the computer should have counted the correct number of T1s and T2s, “mis-coded” or not. If its coded as T1, wrongly or not, the computer counts it as T1.

“Mis-coding” does not explain why there are more or less T1s listed than those counted and that's what happens in the Booking sheets.

But that’s not all from Insane on this subject:

“Some numbers correlate if you just count the ones on a Mark Warner holiday, but others don't, so that isn't a full explanation.”

Insane coming to Mark Warner’s rescue.

Insane should also clarify if to correlate one should or not count the times in which MARKWARNER.CO.UK is misspelled like in the examples below:

But what one really has to wonder is from where Insane has got the Mark Warner’s subtotals.

Without a subtotal one cannot say that subtotal is correct.

Note that Insane recognises numbers don't add up and he has no explanation as to why that happens.

And we agree totally with Insane when he says: “There cannot be more families than there are apartments in which to house them”.

Again, sometimes truth is so evident that even Insane has to accept it

PS.3. Naming names

Insane seems to be worried as to why we have written up names:

“Certainly it's a mystery why you reproduced all the guest names again and again.”

We are not accusing any of the people that Ocean Club, because they appear on these sheets, of anything. If they had nothing to do with this case we see no reason for them resenting the fact that we are doing so.

And we are not naming names needlessly. We are merely transcribing what is the booking sheets. We were not the ones who put their names in these doctored documents.

We were transcribing (and have done the same in this post) them so that readers can understand from where exactly we have obtained the information which led to our conclusions. We are simply being completely transparent.

If they do feel any sort of resentment they should address the Ocean Club management.

If the list presents a name of a person who wasn’t there that week we can only but note that nothing has been said to the appropriate authorities in the past 8 years.

Speculating, if someone promised others that there was no problem in their names being on those lists and now it appears that it won’t exactly be the case, it’s a problem between the one who promised and the ones who believed in the promise, not ours.

PS.4. Apartment designations:

We wrote:

“These are: T1 (1 bedroom), T2 (2 bedrooms), T3 (3 bedrooms), T3F (?? bedrooms), T4 (4 bedrooms), T3FP (?? bedrooms) and T3FB (?? bedrooms).”

Insane responded:

“It means ''Beach Front'', you (censored).”

We suppose Insane doesn’t mean ''Beach Front'' but ''Front Beach'' as the acronym in T3FB is FB and not BF.

Then we suppose the FP in T3FP means ''Front Pool''.

And the F in T3F means just ''Front''. To whatever.

Logic without fault we would say. NOT.

By the way, in the hotel business the acronym FP stands for Full Pension and FB is for Full Board. Why they would be associated with apartment designations we haven't the faintest idea.

PS.5. Big Round Table

Insane dixit:

“Until next time, I shall leave you with this

It's from the Ocean Club

And it's a big
(censored) round table. Enjoy”

Yes, it's a big round table but it only has 6 seats, not 9 (or 10 if you count Quiz Mistress)

Yes, it's from the Ocean Club but don't see any such table, or even a similar one at Tapas:

By the way Insane, did you know that your photo can be seen in a link placed by Anonymous at 8 Mar 2014 19:51:00 in a comment to our post “The proof Ocean Club reads Textusa”?

In that post we show the only existing image of THE alleged Big Round Table.

The real thing, as we know, never existed.

Nova Gente: Interview With Gonçalo Amaral
For the first time, Gonçalo Amaral speaks about the case that destroyed his career, his family and his health...
“My life is gone, I’m only alive due to my heart”
Condemned to pay 500 thousand euro to the parents of Maddie, the little English three-year-old girl that disappeared in Praia da Luz, in the Algarve, on the 3rd of May of 2007, the former inspector will fight until the last legal instance, because he is “a free man and citizen” with “the right to express opinions”.
What was your reaction when you found out that the verdict from the court was unfavourable to you in the defamation suit that the McCanns filed against you?
I found out about the verdict through a friend who called me telling me about the news on the radio. I immediately called my lawyer, but he hadn’t been notified and the verdict was not in the process. It’s sad, but my lawyer could only access the sentence, that afternoon, because a British journalist sent it to him by e-mail. There is no doubt that the couple’s lawyer has good connections at the court. My reaction was one of calm and a wish to read the full contents of the verdict as soon as it was available on the Citius website, which only happened the next day, but with the date of the previous day. Mysteries which the webs of justice weave.
    Were you surprised?
I wasn’t surprised, it was one of the open possibilities, but after the decision about the matter of fact, which was favourable to me, I trusted that the verdict would come in the same direction.
Do you think there are errors in the process? Do you feel wronged?
Those are not mistakes, but value judgements and understandings that are contrary to mine and to that of many other jurists. As for feeling wronged… What do you think? I can only ask if those who, for more than five nights, left their three children, aged three and two, to their own devices in a house within an unknown space, subjecting them to a thousand dangers, while they were partying with friends – not to mention the amounts of alcohol that was ingested on those occasions -, still has the right to be compensated. They practiced a crime of exposing and abandoning defenceless children and they weren’t even accused of that fact. Looking at our criminal legislation, at the English child protection legislation and at cases that recently happened with British subjects in the Algarve, after drunken nights, all that I can say is that the McCann couple is primarily responsible for their daughter’s disappearance. She only disappeared because they neglected her guard and, as parents, they were obliged to it. It is a fact that they lost their daughter, but that doesn’t give them the right to sue anyone or to be compensated. They can’t escape their guilt, which is enough to rob them of their sleep, to provoke a lack of appetite and even rage, but against themselves and not against someone who only wrote down what happened during the first five months of the investigation, according to what is in the case files. If compensation takes place, all that I can do is warn you: be careful, there’s people who may turn this into a new business!
    part 1

  2. part 2
Don’t you feel revolted by this verdict?
I don’t feel revolt, but I do not conform to it, I still trust our country’s justice system, for which I have worked for over 25 years, and I still am a free citizen with all my rights. On the other hand, even the question that Maddie’s siblings, then aged two, may someday read my book and become traumatized doesn’t concern me. Those two children were also abandoned for over five nights in a row and surely they will understand that what is written there is the result of a criminal investigation.
There is a question that those two children will certainly ask when they grow up but that question will be directed at the parents: why were they abandoned, left to their own devices? Those children are free to think and to conclude that whatever happened to their daughter could have happened to one of them. The parents can only fear that their two children who did not disappear on that tragic night revolt against them.
The court says that you caused Maddie’s parents and siblings moral damages…
In my understanding, there are no damages that, objectively and factually, may have resulted from my writing. Which is to say, there is no causal nexus between the book or the documentary and any damages. On the other hand, what is spoken about, like the feelings of rage, it can hardly be considered a damage.

    ReplyDelete
  3. part 3
The couple demanded one million two hundred thousand euro. The court has sentenced you to pay 500 thousand euro – including interest since 2010 – over damages that were caused by the publication of the book Maddie: A Verdade da Mentira. Aren’t both the request and the damages awarded by the court exaggerated?
There is no defamation crime, I haven’t been tried over any crime, if at all I am being tried over an offence of opinion, something unthinkable 40 years after the revolution of April of 1974, which ended the [fascist] Estado Novo, censorship and all the means that oppressed Portuguese citizens from thinking, speaking and writing freely. On the other hand, what is in the book is in the process, those are not lies, that can be verified by comparing the case files with the book and this court has not put that truth at stake. Nonetheless, a compensation of that amount only clarifies that the McCann couple is worth more than any Portuguese citizen, dead or alive, and that they are above any god or divinity, which, according to politicians, Portuguese intellectuals and others from the so-called democratic world can be criticized, ridiculed and satirized. Look at the discussions about the terrorist attacks against French newspaper Charlie Hebdo… With my book I did not defame, nor did I have the intention to defame anyone, but merely to report what happened during the first five months of the investigation, thus replying to the attacks against my good name and my professional dignity. There is no, no can there be any, reserve duty that superimposes our right to react and to defend ourselves from defamation and injustice, putting the truth back when our fundamental rights are violated, even when the authors of such attacks are subjects of a powerful country, to which Portugal has always bowed, with a short interregnum when the Portuguese Republic was founded, largely a result of the English ultimatum.
Apart from the payment, the court decreed the prohibition of the sale of new editions of the book Maddie: A Verdade da Mentira. Nevertheless, the Appellate Court had decided to annul this prohibition back in 2010…
This court has not undone what had been decided by Lisbon’s Appellate Court within the injunction that was filed by the complainants. It should be clarified that the only decision that has, so far, become effective is that of Lisbon’s Appellate Court. That is the only one that is in force, the rest is still subject to appeal and it will take a few years to come into force, while I hope that our superior courts will see this differently from the lower court. This is just the judicial system working, therefore we need to remain calm.
In a more practical manner, I can say that the claimants, the McCanns, haven’t won anything yet, they only lost, namely with the decision from Lisbon’s Appellate Court, which is very clear in stating that the rights that have been violated were mine, that I, within the exercise of freedom of speech, could write the book and practiced no illicit action.
With this prohibition, are you forbidden from emitting an opinion about the case or about the McCann couple?
I am a free man, and like any other citizen in this country, I have the right to express my opinions. I was a Criminal Investigation coordinator, a policeman, and there is no reserve duty, a functional or merely instrumental thing, from the exercise of a profession, that superimposes a fundamental right and freedom of expression. To state that the duty of reserve limits freedom of expression for life, or even during the exercise of the profession of policeman, is to elevate that duty, which is merely administrative, above freedom of expression and fundamental rights, consecrated in the Constitution of the Portuguese Republic, in the Universal Declaration of Human Rights and on the European Convention of Human Rights.

  4. part 4
When you wrote the book, did it ever occur to you that you could be committing an offence?
I wrote the book because I, those who worked with me and the institution of the Judiciary Police were being put at stake. My good name and professional honour were severely attacked. In a first phase, I started by writing to the Judiciary Police’s national director, asking him to allow me to defend myself publicly or to come out to defend us, and I obtained no reply. Today, after all these years, I know that Dr. Alípio Ribeiro never received my letter, which was simply set aside by someone hierarchically below him.
Faced with the inertia and the silence from the institution that I belonged to, which, in my opinion, had the duty and the obligation to come out and defend the men and women who, with their work and great sacrifice, tried to protect it by performing an investigation at the level of any minimally developed country, I decided to ask for my retirement, and to report the criminal investigation that had been carried out and the conclusions that were reached up to the moment that I coordinated said investigation. At that time we already knew that the case was going to be shelved and the investigation abruptly ended. Everything was being prepared in that sense with the agreement, at least tacit, from the parents of the missing child, with the case files being delivered to journalists by the Public Ministry, which in itself question the duty of reserve to which, according to some experts, the policemen were subject to.
The book was a way to reply to the humiliation and the offences that I have been targeted with. Deep down, that was it: they say we are incompetent, they say we are a third world police force, drunkards, fat, lazy, etc., etc., and the Judiciary Police does not set out to defend us. Therefore I turned to writing, reporting the investigation that had been carried out, so people could draw their own conclusions. What happened next is known.

  5. part 5
Do you feel abandoned by the intellectuals and the writers of this country?
Since I left the Judiciary Police, I am part of no institution, I have no political party, nor am I a member of any sports, recreational, cultural or social association, I do not belong to any congregation or obedience. I wrote three books (Maddie: A Verdade da Mentira; A Mordaça Inglesa; Vidas Sem Defesa), but I do not consider myself a writer. I’m an outsider.
Is freedom of expression not compromised by this type of verdict?
What is happening to me, since 2009, is an attack against freedom of expression and a trial over an offence of opinion. The intellectuals of this country, in general, have reacted with indifference. I am not part of their group, and to make things worse I’m an ex-policeman, something that is reproved by many. As far as I remember, only Dr. Francisco Teixeira da Mota, when the Appeals Court’s decision came out, wrote about the matter, saying that the decision had been correct, as the Portuguese State risked being condemned by the European Court for Human Rights… Someone asked me why the Portuguese Authors’ Society had not come out to defend freedom of expression and to denounce the attack that is underway. I replied I was not a member, which may explain the silence.
Are you still dedicated to writing?
I continue to write, but I have yet to decide when to publish. At the moment, I am writing my memoirs about the profession of criminal investigator.
Why are you economically suffocated? Your house in Tavira went to the bank, your consultancy firm had to close, one third of your pension is arrested…
To all of those questions I only reply that my life is gone. If I am alive, it’s due to the heart that I have.
Have you never considered suing the McCanns over the damages that they caused to your family?
Each thing in its own time, it won’t be only the McCanns, but their group of friends, and other people and entities that will be sued. There is an illicit action that was indeed performed, the neglect in guarding their children, which caused direct damages to many people, not only to myself, but for example to the Ocean Club workers, who were fired and saw their lives change, many of them unjustly passing from mere employees and heads of family to suspects in a criminal investigation, while they had nothing to do with the matter.
Is there a project that you would like to realise some day?
I would like to channel all the support that I have been receiving into the creation of an institution to support children and teenagers at risk, in a perspective of educating them for life, escaping the benefits perspective, promoting and building life projects with them, helping them to escape marginalization and the labeling process.
With so many problems, do you still have time to dream?
Dreaming is a part of free men, it costs no money, it can’t be bought, and we just live and feel it.
What remains unexplained in this case?
I don’t answer that question. Faced with what was said by the couple, after the verdict was known, that they felt stronger, I just feel like saying that only vampires become stronger with their victims’ blood. Like Zeca Afonso [Portuguese songwriter and singer] sang, “they eat everything”…

Posted by portugalpress on May 15, 2015

Top British cop vows “Maddie hunt must continue” while “troll noise” reaches fever pitch

In the UK today, Metropolitan Police chief Sir Bernard Hogan Howe has confirmed the multi-million pound investigation into the disappearance of Madeleine McCann from an Algarve holiday resort eight years ago must continue - no matter what his union, or indeed anyone else thinks.

Talking to Tom Pettifor of the Daily Mirror, Sir Bernard “reacted angrily to concerns raised by the Police Federation about the millions devoted to the case”.

“It’s not for them to decide which investigation we carry out. It’s my decision,” he told the Mirror. “This investigation is funded by the government and the only thing that will decide whether or not it continues are the chances of success in finding that girl.”

John Tully, chairman of the Met’s police federation, showed in March that rank-and-file police think otherwise. He declared there were “rumblings of discontent” over the manpower and money ploughed into the Madeleine investigation and that it was “time to refocus” and channel resources into “keeping London safe”.

But as Sir Bernard insists that the Met must continue with the hunt that has purportedly cost over £10 million so far, Britons denounced as “trolls” are channelling money hand-over-fist to the cause of the former Portuguese policeman sued by missing Madeleine’s parents for the message in his book the Truth of the Lie.

Gonçalo Amaral has announced that he is appealing against the decision that leaves him owing a whopping €600,000 in combined damages and interest payments - but it is no secret that the case has left him financially hamstrung. Thus the rallying of support, both here and in the UK is a life-raft.

Coordinated by a group of friends who have sole use of the money for legal defence costs only, it has quite literally kept him going.

“The best proof … is that he has come this far,” one of the fund ‘managers’ told us today. “He wouldn’t have otherwise.”

With the “gofundme” appeal started by Leanne Baulch, a young single mother from Birmingham, getting donations from an average of 70 people a day - and nudging ever-closer to its £25,000 target - Amaral has spoken to Nova Gente magazine about the case that “destroyed his career, his family and his health”, saying “my life is gone. I am only alive due to my heart”.

He reveals not only that he will be counter-suing the McCann parents, their “group of friends” and “other people and entities” “in good time” but that, as far as he is concerned, the couple “practised a crime” and were “primarily responsible for their daughter’s disappearance” by leaving their children alone “for more than five nights”.

It is an extraordinary interview published in full on the “Projecto Justiça Gonçalo Amaral” website set up by one of the friends who has fought tirelessly since 2009 for Amaral’s right to freedom of expression.

She told us how she is buoyed now by the “incredible response” coming every day from British people who have been described by the UK’s Sun newspaper as “sick trolls”.

The Resident has been following the fund and, as we suggested last week, the comments appearing on it do not seem to fit the profile of trolls in any way at all.

Indeed one was so poignant it has spurred Amaral supporters to send it to over 50 British newspapers and media professionals to highlight how strong feelings in the UK are about this eternal “mystery”.

Penned by a donor who gave her name as Paula Seddon, it ran as follows: “Kate and Gerry, you damaged the lives of my children when they were small as they thought someone was going to get into their bedroom windows as their catholic school told them your jack-a-nory story and asked them to pray. We had sleepless nights for years and a security routine to check doors and windows before sleep. Their anxiety and distress caused by your lies. I donated £5 back then to the school fund for you as at the time I thought you were genuine human beings. I cuddled and calmed them as I believed the fiction too. I would like to withdraw that money and give to a truth teller. The truth will be told. You cannot hide behind pity statements by calling people trolls and haters. People are waking up and realising your story is full of holes and had the real story broke back then, my children would not have been scared or scarred by your lies.”
But the day after the message was sent, the UK press ran only with the story that insists the search for missing Madeleine must continue.

Meantime, Amaral’s interview with Nova Gente is being copied, tweeted and sent around the world.

As he tells journalist Alexandra Ferreira, he wrote the book that the McCann couple took him to court over as a “way to reply to the humiliation and the offences” that he has been “targeted with”.

“Deep down that was it. They say we are incompetent, they say we are a third world police force, drunkards, fat, lazy, etc., and the PJ police does not set out to defend us. Therefore I turned to writing, reporting the investigation that had been carried out, so people could draw their own conclusions.”

Asked what remains “unexplained in this case”, he said: “I don’t answer that question. Faced with what was said by the couple after the verdict was known, that they feel stronger, I just feel like saying that only vampires become stronger with their victims’ blood. Like Zeca Afonso sang: ‘They eat everything…’”

  10. Bernard Hogan-Howe seems to think that Anglo-Portuguese relations between investigations are improving, according to his latest comments. Does that mean DCI Wall is having success and managing to get into their investigation where DCI Redwood failed? Textusa, you always seemed to believe that Redwood was trying his hardest to find out what was going on in the Portuguese investigation. Perhaps Nicola was selected carefully in order to make progress where he failed and is achieving that goal. But is that necessarily good or bad... are games still being played?

    1. Anonymous 15 May 2015, 18:12:00,

The game is ongoing. And it has been played fiercely in the past 15 days.

Mr Amaral's defeat was the worst that could have happened to all parties involved.

To Mr Amaral who continues to see all his assets frozen only bare essentials to live on.

To the Black Hats for if Mr Amaral had won, our cheers would have been reduced to a controllable noise by now.

Instead, his defeat has caused an extraordinary reaction from the UK public in his support as it made the issue sustainable in time, cumbersomely for them.

But Mr Amaral’s defeat was not part of the game. It was unexpected by all.

We have noticed other significant moves. In our opinion, the S & S new chapters and the BHH outrage are 2 moves that we see as very positive to our side.

    2. I was thinking along similar lines so encouraged by your response

    3. Thank you Textusa for another very detailed and compelling post :)

As you say Mr Amaral's defeat was unexpected by all, as was poor Brenda Leyland's death.

Both events have been PR disasters for the McCanns, so it seems at every turn, the unexpected goes against them.

The reaction to GA's GoFundMe has been extraordinary and the comments have been inspiring and heartening. Also, so many people have included Brenda in their comments, what happened to her will not be forgotten.

I also agree with you as regards S&S and BHH.

The eighth anniversary of Maddie's disappearance was also marked by the absence of the parents, and what would have been Maddie's 12th birthday was honoured more on GA's GoFundMe than by the McCanns. I found it very touching how many people genuinly care about what happened to that little girl.

Looking at all these things, I see a couple (the McCanns) increasingly isolated and beleaguered.

Thinking out loud at your last paragraph @19:48. Lets say on the UK side the Police/SY/OG are in the middle between the two "hats". Could it be that the PT side "created" the "loss" for Mr Amaral to increase the pressure?

Which has had the effect of BHH doing his nut and calling for the games to end?

  13. Insane’s explanations, uncensored:

“As I pointed out, some guests were incorrectly shown to be occupying a one bed apartment, assuming that in T1&2 the number refers to the number of bedrooms

It seems to have completely escaped your attention that the positive total and the negative totals balance each other and cancel each other out, as do those for T3F and T3FB

And that, basically, is that. Some apartments are incorrectly coded. End of story”

    And:

“The only mistakes of any relevance seems to be that some apartments, in terms of this report, are miscoded.

The most likely explanation is that the field automatically defaults to a specific value - for example T2 - and the operator has to correct to the right one.

I have encountered a similar issue with software many companies use for their employees to track submit and claim their expenses. Each claim can be coded so that individual charges can be charged to specific accounts, but often if the totals overall are correct they will be passed.

If she cannot see that the above shows that there is a disconnect between the two sources, but the overall totals are correct, then she is a bigger imbecile than previously thought”

    1. So computer knows which apartments are miscoded and which aren't?

    2. The amounts are not coded to the wrong apartments; simply the apartments are not consistently coded as T1 or T2 on all the reports. It makes little difference as all charges are linked to the apartment number.

    3. So how do you account the daily difference of around 30 apartments between the listed and the totals? Miscoding?

      You responded:

“Or you can say ''Oh look, an elephant'' Then realise the elephant is nothing to do with the case, and move on.”

We know that you would like for us to move on. Don’t understand the complaint because, if anyone has moved on it has been us.

We haven’t stayed stuck on whooshing curtains, last picture pixel analysis, dog reliability (shame on all who question their efficiency) or DNA lottery defying probabilities.

      We have moved on.

But if by moving on you mean away from the elephant in the room, as we believe you would so much like us to do so, sorry but we can’t.

For us an elephant in a room is not a natural event unlike people like yourself really try hard to make it appear to be.

A elephant in the room is something that has to be clarified. Only after doing so can one says “the elephant is nothing to do with the case”.

And the more we investigate, the more it seems this elephant has to do with the case. We would even say that this elephant is the case.

But enough of elephants for now.

Have you ever heard of the story “3 penguins in the desert”?

You haven’t? You may hear of it soon.

      A clue. It’s a children’s story.

But in my naivety I have to ask if Maddie died accidentally would the parents and others go to such lengths for so many years to cover up the swinging party. I suppose they have done but thats the hardest part for me to understand. Its not like swinging was invented by them....

Personally just looking at the pictures of the tapas is enough to convince me that a holiday company would not offer it as a dining option in even a 1 star aaccomodation. I look forward to another 1 of your posts about the BRT. I have to say I would be in no doubt that the OC are monitoring your blog and given the increased traffic through it for these posts would have made an attempt to refute your posts if it was possible. If insane and the rest of the eejits are the best they have come up with......I'm very interested on why you think the S&S additional chapters are a shot for our side. I agree it wasn't wrote to bolster sales, after the first week on sale I never even seen their book on sale again. 1. Anonymous 17 May 2015, 10:49:00,

The reading that in our opinion should be made of S & S chapters 25 + 26 is of its strength as a move.

Starting to with Chapter 26. Objective - let’s slander the dogs.

So they got one person from the science world and an anonymous scientist:

“One is Dr Maureen Smyth, who was the Director of DNA with the Republic of Ireland's forensic science service until her retirement in 2014. The second, British, scientist we consulted is of similar prominence but asked for anonymity because he is engaged in another ongoing, high profile investigation.”

Note that by saying that it’s the opinion of 2 but then not specifying what each has effectively said we cannot criticise either on anything because whatever we may criticise one may have been the other saying it.

The anonymity of one of the scientists is, as we have seen their most important character (according to them) the anonymous woman who says she sees burglar exiting her living room, the S & S professional watermark.

One cannot but note that by bringing only now the dog issue only confirms their very poor research skills on the part of this so-called investigative team of so-called authors.

The research in such important subject should have all been done before the publication any work and they even go to the trouble of explaining why they have only now come across this crucial piece of information.

But is Chapter 25, or the whining chapter, that is most revealing.

To attack Brenda Leyland is beyond contempt. It’s disgraceful, disgusting but above all, disrespectful to the woman. It simply shows what moral values these people, and not speaking only of S & S, abide by, which are none whatsoever.

But it shows what the values of the trumps they hold up their sleeve.

From the beginning of the month we have noticed there has been intense activity in the game. If from the other camp the best they’ve got is an attack on a person who killed herself then it shows clearly that the trumps that they have up their sleeve and that they can use hold very little value.

Note, the trumps they can use publicly.

Never underestimate those they can use privately.

Hope to have answered your question.

    2. with reference to the Lady Mrs, Brenda Leyland, rest in peace, but some how the dregs of humanity S&S and cohorts still demonize people in extreme use of the T word it is disgusting behaviour, but as they say"stick and stones, may break my bones But names will never hurt me"
It must really hurt them on the inside for the contempt they had for a person, who was given the task to Investigate the disappearance of Madeleine McCann, the Portugal people do not want a Murder on their hands Eh Kate, as she quoted?
As Mr Goncalo Amaral quoted, the persons involved in the Actions they had taken that night are the real ones who have to live with what they have sown, it cannot be turned back just like time, memories may fade but the PJ files are held in a public office of a crime committed against an innocent child, shame on them!

  17. What I find very strange is the fact that many have no problem in believing some of the nannies lied, but somehow can't accept tapas staff did the same. Jeronimo Salcedas was a UK citizen.
A child care worker who decided to be a waiter for the summer.
Was he actually meant to be doing child care, but to have him designated as the waiter who witnesses the checks was very convenient.
The critics of non dining don't seem consider the ridiculous amount of staff for so few customers.

Maddie cop slams McCanns over 'gag': Ex-police boss to fight court ruling

THE former police chief in the McCann libel case claims he has been gagged.

By Jerry Lawton / Published 18th May 2015

Goncalo Amaral said he had been the victim of “an attack against freedom of expression”.

He added: “I am a free man and like any other citizen in this country I have the right to express my opinions.”

Mr Amaral, 55, has been told to hand over £357,000 after accusing Kate McCann, 47, and her husband Gerry, 46, of covering up their missing daughter’s death in his best-selling book.

The ex-officer, who headed the initial investigation into Madeleine’s 2007 disappearance, is appealing the ruling by a Portuguese judge.

He claimed he had been “tried over an offence of opinion”.

Mr Amaral said the damages would bankrupt him.

He added: “My life is gone. I’m only alive due to my heart.”

He told Portuguese weekly magazine Nova Gente everything in his book was contained in official police files.

Yet the judge’s ruling meant the McCanns were “worth more than any Portuguese citizen dead or alive” and “above any god or divinity” in that they could not be “criticised, ridiculed and satirised”.

He said: “Look at the discussions about the terrorist attacks against French newspaper Charlie Hebdo.

“With my book I did not defame, nor did I have the intention to defame anyone, but merely to report what happened during the first five months of the investigation thus replying to the attacks against my good name and my professional dignity.”

Mr Amaral plans to countersue the McCanns. He said: “It is a fact that they lost their daughter but that doesn’t give them the right to sue anyone or to be compensated.”

The McCanns, who sought £1million damages, told the libel hearing they were “devastated” by his allegations.

We trust fully those responsible for the GoFund donations.

It's clear that money is going to PJGA

Both fundraisers are legitimate and connected.

If that wasn’t the case PJGA would have reacted by now as the GoFund has been significantly in the news and in social networks

Yes, contributions from mock names like Charles And Camilla demeans the fundraising but comments can't be censored so they have to appear.

Do these few stupid comments shadow the vast majority of genuine and concerned ones from the good people who have donated and we urge in continuing doing so? Certainly not.

We received a “DO NOT PUBLISH” comment from an Anonymous at 8 Mar 2014 09:38:00.

We will never publish a “DO NOT PUBLISH” comment under any circumstances but we think we can say, without breaching any confidentiality (taking into account the spirit of the comment), that in it was, among other things, a link for our analysis.

      This is the link:

It's a hotels.com promotional page regarding Praia da Luz Ocean Club.

In it there are 27 pictures.

As it’s a promotional page we suppose that all 27 pictures in it were either submitted or approved by Ocean Club. Promotional photos for commercial purposes.

Pictures #11 and #17 are about Tapas Bar:

      (picture #11)

      (picture #17)

In both pictures we can see that the chairs are different from the ones we have seen at Tapas up to now. However the tables are identical to those we can see in Mr. Amaral's book and in the CNN video.

Chairs suffer much more from wear and tear and are much cheaper to replace than tables, however wobbly and flimsy.

One can note that there are no tablecloths. In pic #17 we can see some placemats are used.

Both pictures just show a snack-bar/tapas kind of esplanade, not one from a grill-house.

In pic #11, we can see some tables in the background behind the tree:

      (detail of picture #11)

As can be seen, the chairs are side by side indicating that it’s either a long table or, most likely, the joining up of 2 sets of 2 small square tables, just like the sets in the foreground.

      No sign of the BRT."

  22. Something I recall from sage - it's not always as simple as "What was the computer counting".

Sage offers a very special feature - the ability to construct any report conceivable which is what gives them such a competitive edge. The package comes with a suite of reports that can be either used or modified for each individual user. When you use the report generator it takes you into a labyrinth of tables and fields where it's very easy to choose the wrong option and produce a garbage report.

    https://www.youtube.com/watch?v=F2mezD2jCd8

You can sometimes tell which fields were added by simply looking at the report headers - if they're not lined up or if the spacing seems wrong. In this example if the field "type" wasn't taken from the right table or of the joins weren't done correctly it will produce incorrect totals.

      • Providing first and second line support to Profitus’ software resellers

Not seeing what's the use to pay for a software that "takes you into a labyrinth of tables and fields where it's very easy to choose the wrong option and produce a garbage report" and where a "suite of reports that can be either used or modified for each individual user".

Or to put in another words, pay to have unreliable reports produced (as anyone can intervene in it) with totals different from what is listed and so handing out to their employees information that may or not be true ir even make any sense.

    3. Textusa,

I am anon 15:41:00 not Insane.

I don't know Profitus so I used Sage as an example because it's a popular system. My point is that many systems facilitate report generators and I have used them many times in the course of my work. What we don't know is if there was a similar reporting tool on Profitus.

If I buy a system without a report generator it means that I have to pay out £££ for each custom report that I require. If I buy a system with a report generator I just need to pay an initial fee for training and I can have all the reports that I want. I can then lock down the options so only trained users can modify reports.

I've worked in systems, programming and data for over 30 years and seen many instances where reports don't "add up". There is usually a very rational and logical explanation.

My earlier comment wasn't aimed at poking holes in your thesis - just to share with you what I know. If you'd rather I refrain from commenting in the future then I will do so.

    4. I have used Sage and Access as well as other in house systems to produce reports and NONE of them produced anomalies.... both reported what was asked of the software and had criteria that could be selected to suit the reason for the report. If the software isn’t capable of producing a report as required the operative would not request it. We used Sage at our business and reports were pulled off for various reasons such as for the bookeeper, for the accountant, the bank, marketing purposes, re-ordering stock and very importantly for producing invoices for customers.

A huge organisation like MW would not use crap software and I’m surprised Profitus doesn’t come after them for trashing the reputation of their software.

Our apologies. As your intial comment had clearly the intention to misinform we confused you with Insane.

Intention that continued with the comment that followed.

We're sure you will understand the reason for this confusion, if you're not Insane that is.

It was fascinating to read this phrase: "I've worked in systems, programming and data for over 30 years and seen many instances where reports don't "add up"."

But as you say "There is usually a very rational and logical explanation".

      Exactly.

We think we have given the very rational and logical explanation as to why data listed does not tally up with the totals added up by the computer. And because it is a computer, it always adds up correctly what it is told to add up.

      Thank you.

Amaral defiant about his Maddie book

Former detective Gonçalo Amaral has responded defiantly to the outcome of the civil action brought against him by Kate and Gerry McCann over his book about the investigation into their daughter’s disappearance.

The McCanns were awarded €500,000 plus interest in damages, but Amaral is adamant the book was not defamatory and was within his rights to freedom of expression. His views on the case are contained in an interview published in the Portuguese weekly magazine Nova Gente and reproduced on the website of Projecto Justiça Gonçalo Amaral.

“With my book I did not defame, nor did I have the intention to defame anyone, but merely to report what happened during the first five months of the investigation, thus replying to the attacks against my good name and my professional dignity.”

The information in the book is all in the Portuguese police case files and this was not in question during the McCann’s civil action, he said.

Asked if he felt wronged by the McCann’s legal action against him, Amaral insisted the parents were primarily responsible for their daughter’s disappearance because “they practiced a crime of exposing and abandoning defenceless children. The fact that they lost their daughter did not give them the right to sue anyone or to be compensated,” he said.

“They can’t escape their guilt, which is enough to rob them of their sleep, to provoke a lack of appetite and even rage, but against themselves and not against someone who only wrote down what happened during the first five months of the investigation, according to what is in the case files.”

That Madeleine’s younger siblings may someday read his book and become traumatised by it did not concern him, he said.

“Those two children were also abandoned for over five nights in a row and surely they will understand that what is written there is the result of a criminal investigation. There is a question that those two children will certainly ask when they grow up, but that question will be directed at the parents: why were they abandoned, left to their own devices?”

As to what really motivated him to write Maddie: A Verdade da Mentira (Maddie, the Truth of the Lie), Amaral said he wrote it because his good name and professional honour, as well as that of those who worked with him, had been severely attacked.

Essentially the book was a way to reply to the insults he and his colleagues had been subjected to by the British press and others. “Deep down, that was it: they say we are incompetent, they say we are a third world police force, drunkards, fat, lazy, etc., etc., and the Judiciary Police does not set out to defend us. Therefore I turned to writing, reporting the investigation that had been carried out, so people could draw their own conclusions.”

In his latest interview, Amaral had no qualms about stating his views on the civil action or the McCann couple: “I am a free man and like any other citizen in this country I have the right to express my opinions.”

He agreed that as a result of the court action he and his family had suffered greatly. “My life is gone. If I am alive, it’s due to the heart that I have.” But he does not intend to let the matter rest there or give up without a fight.

He reiterated that he will fight “until the last legal instance”. He intends to appeal the €500,000 damages verdict and is considering suing the McCanns.

“Each thing in its own time, it won’t be only the McCanns, but their group of friends, and other people and entities that will be sued. There is an illicit action that was indeed performed, the neglect in guarding their children, which caused direct damages to many people, not only to myself, but for example to the Ocean Club workers who were fired and saw their lives change, many of them unjustly, passing from mere employees and heads of family to suspects in a criminal investigation while they had nothing to do with the matter.”

Meanwhile in the UK, the Mirror newspaper has reported Sir Bernard Hogan-Howe, the Metropolitan Police Commissioner, as saying that the search for Madeleine will not end until all avenues are exhausted. He was reacting to concerns raised by the Police Federation about the millions of pounds of public money devoted to the case.

Sir Bernard said of the investigation: “It’s moving on apace at the moment in terms of the relationship with the Portuguese and that is to be welcomed. As long as there’s a basis for doing the investigation we will continue.”
