  3. Joana Morais sent me the newspaper article published October 27 and which we mentioned in our comment at 27 Oct 2020, 11:05:00. We then said that the article was an online exclusive and we were wrong, as it was published that day in the paper edition.

    The meeting was secret and it took place recently in Lisbon’s PJ. It brought together English and German authorities and had as objective the gathering of evidence to find Madeleine McCann. For now, the data remains circumstantial, but the Germans have already taken the elements of two other cases, which allow Christian Brueckner, the main suspect in Maddie's disappearance, to be maintained in prison.

    The objective is to be able to draw a profile of the German, that will help the authorities to understand how he will have disposed of the body, after having abducted the English girl in the Ocean Club.

    The searches in the basement where the man lived for several years revealed nothing, nor even did the DNA profiles collected in the apartment where the child disappeared place the suspect at the scene of the crime. But several witnesses have already been heard that indicate that Christian Brueckner knew the Ocean Club well and knew about Maddie's parents' routines.

    For the German authorities, there is little doubt that it was Christian Brueckner who killed Maddie, after kidnapping her, but the biggest thing left to know remains the place where the body was hidden.

    At the meeting that took place recently in our country, the PJ reported all the diligences it did in the Algarve, namely the searches carried out in various places and which proved to be unsuccessful. Wells and holes were finely combed, but there was no sign of any of the girl’s remains.

    The German authorities asked the PJ for details of two other cases, which could allow to maintain suspect in prison for several years. For now, the German is serving time for the rape of an American woman in Praia da Luz – a seven year sentence - but he could soon be accused of a rape in 2004 and an attempt to kidnap two children in 2017. Both crimes occurred in the Algarve.

    Portuguese, English and Germans do not give up on the investigation and for now continue to try to gather information about the suspect's past. It is essential to understand the routines in 2007, when Maddie disappeared, at the same time that Christian Brueckner lived nearby

    Conversation in cafe relaunched the investigation

    SECRET - Friend said that Brueckner confessed to the crime in 2008. But he only revealed it eight years later.

    The Brueckner investigation was born out of a coffee conversation. Helge Busching, who met the German when Maddie disappeared, in Praia da Luz, Lagos, says the suspect revealed to him having been involved in the child's disappearance in 2008.

    Busching, who helped convict Brueckner for violating the 73-year-old American woman - stole from him the camera he used to film the crime - gave name of the German to the English police in 2017, on the 10th anniversary of the girl's disappearance .

    He assures that Brueckner told him, during a festival in Spain, when they were in a cafe, that he had been involved in the disappearance. Nine years later, after Busching was arrested for immigrant trafficking in Greece, he said he wanted to speak to the British police. In Athens, when asked what he thought of Brueckner, regarding Maddie, he replied: Guilty.

    The suspicions were later passed on to the Portuguese police, who managed to place Brueckner’s the cell phone in the vicinity of the crime scene. It was Busching who revealed the number that the friend used at the time.

    Mother was arguida
    The PJ even followed the line that Maddie was accidentally killed by her mother, and Kate was constituted arguido for negligent homicide. She was never accused.

    Contaminated scenario
    When the PJ arrived at the room where the girl slept in 2007, the scene had already been contaminated. Tens of people had been at the site and tens of DNA profiles were collected.

    Case reopened
    After being archived, the case was reopened and the case was sent to the Porto’s PJ who became in charge of reading all the documents. The objective was to try to find new lines of investigation. It was only then that the hypothesis of the girl's abduction and death gained strength.

      It’s all a storm in a teacup.

      The secret meeting in September was at PJ HQ in Lisbon, with German and English police, to exchange information about Brueckner.

      It seems to have allowed the German authorities to gather elements relating to 2 other cases which could keep the suspect in prison for several years.

      The meeting reportedly had the objective of drawing a profile of Brueckner, in order to understand how he got rid of Maddie’s body.

      However, the 2 cases refer to the rape of Hazel B, where is has since been established that Brueckner’s DNA didn’t match and the Salema beach incident in 2007, where a man carried out an indecent act in front of 10 year old Joana E.

      In the latter case, the girl couldn’t identify Brueckner as the man from photographs.

      Neither case involve abduction or intent to abduct. We cannot see how either will shed any light as to how Maddie’s body was disposed, even if there was solid proof that Brueckner was linked to either or both.

      The fact that there is no proof that he was involved in either makes it all even more absurd.

      The Irish authorities were represented at the September ECJ hearing by J Quaney and M Gray, QC. This must relate to their interest in the case of Hazel B, although the published hearing transcript makes no reference to that case.

      The article seems to confirm that it was Helge B who gave Brueckner’s mobile number to the police, who then traced the call as being made in the general area of PdL.

      It also confirms that the number was not in the PJ files of 2007 relating to the Maddie case.

      Isn’t it likely that the mystery caller that night was Helge B himself, as he did say he was living in the area at the time?

    MADELEINE McCann's parents face fresh heartache after prosecutors revealed they would not be charging the prime suspect until next year at the earliest.

    Convicted rapist and paedophile Christian B, 43, was identified as the man responsible for the three-year old's kidnap and murder by the German authorities in June.

    Kate and Gerry hoped it would mark the end of their 13 year agony at not knowing what had happened to their beloved daughter but now their hopes have been dashed.

    Speaking exclusively to The Sun, prosecutor Hans Christian Wolters admitted leads had dried up and there would be no developments this year, with charges unlikely before the Spring and only if they find more evidence.

    He said: ''I cannot say how long our investigation will go on for but I know there will be no developments this year, in 2020. We had hoped to charge him but that has not been possible.

    ''Maybe we hope to have something by the Spring of 2021, maybe it could take longer but certainly nothing this year.

    ''We have some evidence against our suspect but it is not strong enough. We have proof that he was involved and that he killed Madeleine but it's not strong enough to charge him.

    ''We need more evidence and more witnesses but if we don't get them then the case may drop but we hope that will not happen and he will be charged.''

    His downbeat comments are in contrast to June where he announced in a headline grabbing news conference he had ''concrete evidence'' Maddie was dead.

    He added: ''So long as we have something to investigate then we will investigate but if no witnesses come forward then we will have to come to an end but at the moment I can't see this point.

    "It may be that we have to make another appeal to see if we can get any more tips.

    ''We have not been in touch with Madeleine's parents other than a few months ago when we made the announcement of our investigation because there is no need to."

    Last month Christian B's lawyer Friedrich Fulscher - who insists his client is innocent - called on prosecutors to reveal their evidence to be ''fair'' to his client and the McCann family.

    He added: ''The prosecutor has not revealed anything to us about the investigation.

    "They are adamant but they are chasing someone who is just convenient to them.''

    Madeleine disappeared from her holiday apartment in Praia da Luz on Portugal's Algarve coast in May 2007.

    Christian B - who has convictions for rape and child abuse - is currently serving 21 months for drug offences in Germany's Kiel prison.

    At the end of last month we reported how Scotland Yard detectives reportedly held a secret meeting with German and Portuguese police in Lisbon in a bid to find Madeleine.

    Three wells near Praia da Luz are known to have been searched in July but police and firefighters failed to find any trace of Madeleine.

    German authorities are treating the case as a murder inquiry and say they have concrete evidence the missing youngster is dead - but have yet to reveal what this evidence they have.

    The abandoned wells are a 15-minute drive from Christian B's rented cottage on the outskirts of Praia de Luz, on a narrow road leading down to a beach where the paedophile used to park his VW camper van.

    Christian B is also being probed in Germany over a 2004 Algarve rape and a sex attack on a beach near Praia da Luz a month before Madeleine vanished.

    In Portugal, prosecutors have reopened their investigation into a sex crime in a playground he was arrested over in 2017.

    He was held on suspicion of exposing himself to young children at a playground in Sao Bartolomeu de Messines a 40-minute drive from Praia de Luz.

    Police discovered after his detention that he was wanted by Germany on an international arrest warrant for child sex abuse and possession of child pornography.

    He was extradited to his homeland and was never prosecuted in Portugal following his Algarve arrest.

    The criminal probe was mothballed despite protests from the youngsters’ angry parents but reopened in September.

    1. So now it’s possibly spring, if ever.

      OG are out of the investigation now, unless they decide to look for another suspect.

      How would they ever find a better fit than Brueckner? He was their “discovery” in the first place but the German authorities seem to have taken over the case.

      Portugal have done what was requested. They have searched the wells and found nothing.

      Maddie would have been 18 by next May.

      Maybe this is when OG will finally end?

    2. Why no questions for Brueckner?

      Normally, when police have “proof”, as Wolters calls it, surely the next step would be to question the suspect?

      Under interrogation, suspects sometimes slip up and reveal incriminating information.

      The answer to this rhetorical question seems to be the reluctance of the German prosecutor to make the evidence/proof available to the suspect and his lawyer.

      Only when that information is made available can the strength of the evidence be tested.

      One day, Brueckner will be used as a case-study: if one is to ever build a patsy for whatever reason, Brueckner is the polar-opposite of what should be done to achieve that.

    AN international row broke out today as a leaked memo reveals Portuguese cops have rubbished a German probe into Madeleine McCann's disappearance.

    Local officers insisted counterparts in Germany have no solid evidence that prime suspect Christian B was involved in snatching the British toddler in 2007.

    Officials from the Policia Judiciaria in Portugal, Germany's BKA and Scotland Yard met to discuss the state of the probe.

    In June, the convicted rapist and paedophile was identified by German cops as the prime suspect for Madeleine's disappearance in Portugal 13 years ago.

    Prosecutors said they had ''concrete evidence'' she was dead but since then there has been no significant development in the long running saga, leaving parents Kate and Gerry facing an agonising uncertainty.

    Now a leaked memo from the Policia Judiciaria, seen by The Sun, has revealed dismissive comments made in an internal email following the top secret conference in Lisbon.

    In it an unidentified Portuguese officer claimed that the German BKA have no solid leads and are just holding the suspect in jail in the hope they can make two other sex cases against him stick.

    He wrote: ''There is no evidence, just speculation. When reading the German case I was shocked. I never thought that the BKA would investigate so badly.

    "It is not a serious and objective investigation, but only just to keep the suspect in prison at all costs.

    ''The meeting was to get the point of the situation, the BKA wants to investigate the other two cases of possible sexual harassment, so that the suspect does not leave prison until the end of the year and they will drop the suspect.''

    Portuguese cops have been accused of bungling the investigation and lead officer Goncalo Amaral was later fired after pursuing a false theory that Kate and Gerry were responsible.

    Christian B is currently in jail after being convicted of raping a 72 year old woman in Praia da Luz in 2005 - two years before the Brit youngster vanished from the same resort in May 2007 aged three.

    He was given seven years but is appealing. German prosecutor Hans Christian Wolters hit back at the Portuguese cops, saying: "We don't want to comment on this.

    "The accused will have to stay in prison for the next few years anyway."

    Last month Christian B's lawyer Friedrich Fulscher - who insists his client is innocent - called on prosecutors to reveal their evidence to be ''fair'' to his client and the McCann family.

    He added: ''The prosecutor has not revealed anything to us about the investigation.

    THE Madeleine McCann prime suspect needed hospital treatment after claiming he was attacked in a German court cell.

    Convicted rapist and paedophile Christian B, 43, was treated for two broken ribs yesterday, saying he was assaulted as he waited ahead of a parole hearing.

    His lawyer Friedrich Fulscher claimed he had been hurt by officials and he would be filing charges - but the court insisted he had ''fallen over''.

    Police were said to have been called to the court to deal with the incident and the suspect was taken to a nearby hospital for treatment.

    Last night a spokesperson for the court said: ''The exact sequence of events is now the subject of investigation.

    "Against this background, we cannot comment on the details.''

    Christian B was identified by German police as the man responsible for Madeleine's abduction and murder in May 2007.

    Yesterday he was driven from prison in Kiel, two hours south to Braunschweig court where he appeared for a parole hearing in his first public appearance.

    He is currently serving 21 months for drug offences but he is eligible for parole on January 6 after serving two thirds of his sentence.

    Wearing a white mask he was driven into the back of the court building flanked by two police officers before being escorted into the building for the hearing.

    A source at the court said: ''The hearing was to decide on whether he can have parole for the drugs case.

    ''Technically he can be freed in early January as he has served his time but the prosecution is opposing it because of the outstanding Madeleine McCann investigation.''

    Madeleine, three, was taken from her family's holiday apartment in Praia da Luz on Portugal's Algarve coast in May 2007.

    This year investigators in Germany claimed they had solved the world's most famous missing person's mystery.

    They say they have "concrete evidence" she is dead and believe Christian B abducted and murdered her.

    He was known to spend time in the area around the resort and was arrested on other matters.

    Last December the suspect was also sentenced to seven years in jail for raping a 72-year-old American woman near Praia da Luz two years before Madeleine vanished.

    He took his case to the European Court of Justice earlier this year but it was thrown out .

    He is expected to serve the full term although his lawyers are appealing the verdict.

    It means he will not be released even if he wins parole in the drugs case.

    Last week we revealed German investigators vowed to "fight tooth and nail" to convict Christian B for Madeleine's murder.

    It came after Portuguese cops rubbished their investigation and claimed they have no real evidence.

    Madeleine McCann prime suspect Christian Brueckner has reportedly broken two ribs in an incident as he was being taken to court today.

    The convicted rapist and paedophile was taken to hospital in an ambulance after suffering the injuries as he was being taken to court for his first public appearance since he was named as a suspect in the disappearance of the British toddler.

    The 43-year-old was due to appear before German judges to apply for parole in relation to a drugs case that he is involved in.

    He is currently serving 21 months for drug-related offences and is eligible for release on January 6, having served two-thirds of his sentence.

    He was driven from the German prison in Kiel to the courtroom in Braunschweig some 300km - roughly 186 miles - away for a hearing.

    But before the behind closed doors session could start shortly after midday, he ended up being hospitalised and was taken in an ambulance with a blue light where it was later revealed he had apparently broken two ribs.

    He had arrived more than an hour before his case was due to be heard, and was kept in a holding cell where the incident happened that resulted in him suffering broken ribs.

    The ambulance arrived to take him to the hospital 40 minutes after he arrived.

    Eyewitnesses report saying that a prison guard in the entrance greeted the medics telling them: "Somebody's been rioting in there."

    He was in the emergency room for an hour before being led back to court with both handcuffs on his wrists and shackles on his feet and the hearing then continued some two hours late.

    Court officials have refused to discuss the incident, saying that an investigation was underway.

    Brueckner's defence lawyer Friedrich Fuelscher, 36, was heard loudly arguing with prison guards about video footage of the incident from a camera watching the cell where he was being kept.

    It is unclear what this has to do with the fact that he was injured or how he was injured.

    Meanwhile, the Sun reports Mr Fuelscher claimed his client had been hurt by officials and he would be filing charges.

    But the court insisted Brueckner had ''fallen over'' while waiting in the cell downstairs, the paper reports.

    Brueckner's appearance in court was a surprise one today.

    He was named by German police earlier this year as the prime suspect in Maddie's abduction after mobile phone records placed him in Praia da Luz on the night she vanished.

    No press or members of the public were allowed into the the Chamber of Penalties court today.

    Brueckner is at the centre of series of complex legal issues.

    He is currently serving the sentence in the north German city of Kiel for drug dealing which ends on January 7.

    We would have expected the hearing to be adjourned until he had recovered.

    We all know that truth does not exactly follow the Maddie case – trying to pin the blame on him is one example – so we will remain sceptic about this episode. No, we’re not saying that it didn’t happen, we’re just leaving open every possibility.

    Also, we are aware that it has been widely reported that he won’t be prosecuted regarding Maddie. The reader just has join that dot with the one of him being persistently finger pointed as Maddie’s abductor AND paedo-murderer to understand that to the less enlightened Brueckner is just another vile criminal about to get away with it.

    They don’t question that the reason he’s not going to be prosecuted is because he didn’t do it. To them a “couple of broken ribs” befalls under the category of ‘getting what he deserves’. In fact, many will think he deserves a whole lot more.

    That, is called lynching.

    Lynching has material authors but it has also moral authors. Those who drove the material authors to commit said crime.

    The convicted rapist and paedophile, 43, was seen for the first time in public on Monday since he was named by German police as the chief suspect in the three-year-old's 2007 disappearance in the Algarve.

    He was rushed to hospital for treatment after he smearing his courthouse cell with yogurt and filling the toilet with loo roll.

    He was due to appear before a judge in Braunschweig for a parole hearing on an unrelated drugs charge but 40 minutes after arriving he reacted furiously to being filmed and put in chains.

    A source at the court told The Sun: "He got angry at being filmed and complained. He reacted angrily and when he refused to put the shackles on there was a more violent tussle and he hurt himself."

    His lawyer Friedrich Fulscher told the paper that the guards were filming him via a monitor and asked them to stop.

    He added he had to get a judge to ensure the footage was deleted and has filed a criminal complaint against the guards for allegedly beating his client.

    The court has claimed that Brueckner had "fallen over" after arriving at the court from his prison in Kiel and an investigation is underway.

    Brueckner had been driven 186 miles from Kiel to Braunschweig for a parole hearing on his current 21-month drugs sentence.

    He will have served two-thirds of his sentence in January and will be eligible for parole.

    The criminal has been identified by German police as the prime suspect in Madeleine's abduction in Portugal 13 years ago.

      We still don’t understand why Brueckner would do this prior to an application for parole, knowing it would jeopardise his chances of parole being granted.

      We can imagine CCTV recording the holding cell, as that happens in the UK but this seems to suggest the guards were filming him when they had no right to do so.

      About the link between Brueckner and Maddie, if there was ever a situation where it would attempted to prove how a lie told a thousand times will become the truth, this would be it.

    2. Na conversa de café que teve com o amigo em 2017. Eu acredito que de alguma forma CB esteve envolvido neste trama. Aparentemente ele não tem álibi para essa noite, e digamos que era o tipo de pessoa que faria o género de trabalho sujo. Como disse, a haver um corpo, teve de estar escondido temporariamente em algum lugar. CB conhecia o terreno, não tinha qualquer tipo de pudor, era conhecido no resort, precisava de € ou seja seria o tipo de pessoa a quem alguém eventualmente recorreria, se necessitasse.
      A ser, será uma pequena peça no grande puzzle. Não se lhe avizinha um futuro fácil, o que se seguirá às costelas partidas?!

      The rest of you comment, is very, very pertinent and, as the Portuguese say, goes in the direction of Brueckner not admitting anything to anyone.

      His possible link to the case - we believe it could be under similar circumstances of those regarding Euclides Monteiro - would have been made elsewhere, by someone who knew about his possible involvement and not by a petty criminal as was this particular friend.

    Madeleine McCann police were today searching a new property in Germany, local media said, months after her suspected kidnapper's nearby allotment was dug up in a search for evidence.

    Officers equipped with sniffer dogs and a mobile police station descended on a house near Hanover, where suspect Christian Brueckner once lived, after receiving a tip-off from a member of the public.

    Authorities did not reveal the nature of the tip-off, but local newspaper Neue Presse said it was linked to the Madeleine case.

    However, the current residents of the house were found to be 'totally blameless' and the eight-hour search has yet to lead to a breakthrough.

    Prosecutors told Calenberger Online News that the search had backed up their 'gut feeling' that the tip-off was wrong, while adding that investigations were still ongoing.

    A spokesman for the prosecutor's office said there had been doubts about the tip-off from the beginning, but said it could not be ignored.

    Their assessment was downbeat enough that the spokesman even suggested that the tipster could be investigated for making a false complaint.

    In July, German police searched a vegetable garden 12 miles away which was once occupied by Brueckner, digging up the allotment in a two-day operation.

    The allotment was only a short drive away from an apartment block where Brueckner was registered while living in Hanover, and the 'Havana Club' bar which he is thought to have frequented is also nearby.

    One gardener said in July that Brueckner had lived off-grid at the allotment in 2007 and talked about planning his return to southern Europe.

    'I remembered his face from the pictures in the news. And I remember his van and his dogs. I had completely forgotten about him up until then,' said Wolfgang Kossack, 73.

    German media says Brueckner received at least two criminal convictions from a Hanover court, one for forging documents in 2010 and another for theft in 2013.

    He split his time between Germany and Portugal from 2013 to 2015, prosecutors in Hanover have said.

    Brueckner lived in the Algarve for much of the period from 1995 to 2007, and German prosecutors say he received a phone call from a Portuguese number around the time of Madeleine's disappearance in May 2007.

    Brueckner made a living doing odd jobs in the area where Madeleine disappeared, and was also known to have burgled hotel rooms and holiday flats.

    Weeks after the allotment search, authorities indicated they had been looking for digital storage devices, but Brueckner's lawyer accused them of 'desperation'.

    Since taking the lead in the case earlier this year, German police have struggled to explain what evidence they have about Madeleine's disappearance.

    Last week, a leaked memo revealed that Portuguese investigators were 'shocked' by the lack of concrete evidence after being briefed on the case against Brueckner.

    This week it emerged that the 43-year-old was injured while being taken to a parole hearing in Braunschweig.

    The Braunschweig court said he sustained injuries to his ribs when law enforcement officers were putting ankle cuffs on him before the hearing Monday.

    The court said he was treated in hospital and the parole hearing took place, and he was later returned to prison.

    Many police officers and the SEK have been standing in the Ringstrasse since the early hours of the morning.

    Thomas Klinge from Chief Public Prosecutor’s office says dozens of officers are investigating the property and apartment.

    At 6.30 am the son was taken from the house in handcuffs by the SEK and around 10am, the mother and officers left the house. They were digging up everything in the garden.

    The mission was to prevent further criminal offences, but also to exclude any danger.

    Klinge later reports that “Our initial feeling was probably correct because these reports (the tip off ?) have not been substantiated.”

    A family have been subjected to an ordeal on the basis of a tip -off which proves to have been unsubstantiated.

    Nowhere is CB’s name mentioned but it seems more like an operation related to suspected terrorism.

    It just happens to have occurred in the town where CB once lived.

      From THE BEGINNING the tip-off offered little credibility but that didn’t stop the tabloid to write an entire article reenforcing the idea that the patsy is not a patsy but the real cuprit.

      “Since taking the lead in the case earlier this year, German police have struggled to explain what evidence they have about Madeleine's disappearance.”

      They have struggled to explain but as we write these words, we doubt that anyone in the world doesn’t immediately link Brueckner to Maddie.

      To the informed ones because he’s a patsy but to the less informed – who are the vast majority – he’s by now Maddie’s abductor and killer.

    Chief prosecutor Hans Christian Wolters said: “We got leads from England, including ones from tourists on holiday in Portugal during this time.

    “We got some photos where there might be some interesting things on them.

    "There are quite good leads we are following up.”

    But he said the information would take time to pursue and when the UK leaves the European Union this could take even longer as “many things can’t just be clarified at short notice”.

    There were reports in Germany of developments in the case of three-year-old Madeleine who vanished on holiday in the Portuguese resort of Praia da Luz in May 2007.

    But police in Hanover categorically denied any searches carried out were linked to her disappearance.

    Mr Wolters said the formal hurdles in the McCann case post-Brexit will get bigger.

    He said: “In the EU everything was unified, and there was a uniform legal assistance between the European countries.”

    But when the UK leaves he said Germany would have to “make a formal request, which means that we then write a very formal letter and then query everything individually”.

    Phone records put Brueckner near the scene on the night Madeleine went missing.

    He is serving a jail term for drug offences in Kiel, Germany.

    He was sentenced to another seven years for raping a pensioner in Praia da Luz in 2005 but is appealing against his conviction.

    Madeleine McCann suspect Christian Brueckner has lost his parole bid and must complete the remaining time of his jail term behind bars, a court has ruled.

    The chief suspect in the 2007 disappearance of the three-year-old is currently in prison in the German town of Kiel for one year and nine months for drug trafficking.

    He has already served two thirds of his sentence, and in theory would have the right to early parole.

    However, the Regional Court of Braunschweig announced today that he could not serve the remainder of his sentence on probation after hearing the matter on Tuesday, citing his 'multiple criminal record and failed probation.'

    Brueckner's probation for a previous case was revoked because he committed several offences during the probation period, including drug crimes and sexual acts against children.

    The court said therefore in the event of a relapse during his probation period, a serious relapse is expect, Bild reported, adding that the court was unable to determine factors that could deter him from committing further crimes.

    The news comes after reports in Germany on Monday said that Brueckner freaked out in his cell after being barred from smoking and then broke his ribs on a wooden bed when his legs were kicked away from him by prison guards ahead of his trial.

    Brueckner felt that he was being manipulated by the police officers, who had forbidden him to smoke, and was angry at being filmed and shackled ahead of a court hearing, the report says.

    In retaliation, he covered the surveillance cameras in his cell with yogurt and blocked the toilet with paper, according to Bild.

    When court officials entered the cell to arrest him, they handcuffed his hands to his belt, and told him to kneel down so that he could be shackled, Brueckner reportedly told his lawyer.

    When he refused, the prison guards allegedly kicked his legs out from underneath him, causing him to fall on to a wooden bed, breaking two of his ribs.

    The incident came the day before police searched a new property where Brueckner once lived in connection with the case, after receiving a tip-off from the public.

    The convicted rapist and paedophile was rushed to hospital for treatment after the incident in court on Monday. Police are now also investigating the judicial officers involved in the incident.

    His lawyer Friedrich Fulscher claims to have seen surveillance camera footage showing the subsequent firs aid treatment of his client that a constable filmed on her cell phone.

    But last week, Portuguese police accused German cops of having no evidence that Brueckner abducted Madeleine, according to a leaked memo.

    Officers from the Policia Judiciaria said they were 'shocked' after being briefed on the German case against Brueckner, adding there is 'no evidence, just speculation'.

    Portuguese detectives believe the allegations against Brueckner are designed to 'keep him in prison at all costs', and accused their German counterparts of failing to conduct a serious investigation.

    The extraordinary claims were contained in a memo prepared by Portuguese police after meeting with German BKA detectives and investigators from Scotland Yard.

    A leaked copy of the memo was shown to The Sun, in which a Portuguese officer wrote: 'There is no evidence, just speculation.

    'When reading the German case I was shocked. I never thought that the BKA would investigate so badly.

    'The meeting was to get the point of the situation, the BKA wants to investigate the other two cases of possible sexual harassment, so that the suspect does not leave prison until the end of the year and they will drop the suspect.

    'It is not a serious and objective investigation, but only just to keep the suspect in prison at all costs.'

    Portuguese police have been accused of bungling the investigation, including pursuing the theory that Madeleine's parents - Kate and Jerry - were responsible.

    Goncalo Amaral was fired over his handling of the investigation, and successfully sued by the McCanns after pushing the theory they were responsible in a book.

    Hans Christian Wolters, the prosecutor leading the German case, was forced to admit last month that the evidence they have gathered is not strong enough to see Brueckner charged.

    He added that they are 'one witness' away from getting the evidence they need, but so far nobody has come forward.

    Brueckner has previously said he is innocent of any crime relating to the four-year-old.

    The incident is said to have happened on Monday after Christian B was driven 240 miles from jail in Kiel to Braunschweig for a parole hearing.

    A source at the court said the pedophile had "thrown a tantrum'' in his cell, smearing it with yoghurt and blocking the toilet with loo roll, because guards were filming him.

    Madeleine McCann's murder suspect, Christian Brueckner, is reportedly set to stay in prison at least until 2026, reports state. The update came on Friday, September 20, after judges rejected his appeal on a rape conviction. Brueckner was sentenced to seven years in prison in December 2019 for attacking a 72-year-old American woman in Praia da Luz, Portugal, in 2005. The convict had appealed the rape conviction in a technicality, he can now only apply for parole from 2023.

    Brueckner, a 43-year-old pedophile from Germany, was named by authorities in June as the prime suspect in Madeleine's missing case. The three-year-old mysteriously disappeared from her parents' vacation apartment at The Ocean Club Resort in Praia da Luz, Portugal on the night of May 3, 2007. Judges in Germany dismissed Brueckner's appeal and confirmed his seven-year sentence. The news was welcomed by the investigators probing Madeleine's case as one of them said: "t's great news. It means he won't be going anywhere for a very long time and so we can carry on building up our case against him."

    Brueckner, earlier this week, reportedly suffered two broken ribs in mysterious circumstances in his prison cell before applying for parole, which was eventually rejected. Reports state that Brueckner had the injuries after being involved in a scuffle with prison guards after throwing a "tantrum" because he was not allowed to smoke in the courthouse. Latest pictures showed Brueckner being led out of the building to be taken to a hospital for treatment.

    Brueckner had reportedly appealed against the rape convicting in July at the European Court of Justice, claiming that his arrest warrant was applied incorrectly. Germany's Federal Court, in a statement, said: "The Braunschweig Regional Court sentenced the accused to a total imprisonment of seven years for serious rape.

Later, in 2016, he was imprisoned again for a year and three months for "abusing a child in the act of procuring himself and possessing child pornography," and in June 2017 he received 15 months' prison sentence for sexual abuse of a child. Brueckner, as he went in and out of prison, spent his time between Germany and Portugal, where he was living at the time of Madeleine's disappearance. The suspect would have been 30 at the time when the toddler disappeared. His phone records showed him near the resort on the day of Maddie's disappearance.

    MADELEINE McCann suspect Christian B is moving to a maximum security prison ahead of questioning in the New Year.

    The convicted paedophile and rapist 43, is currently serving a 21-month drugs sentence and is in isolation for his own safety.

    In January, that term will end and he will be moved from Kiel maximum security prison to one 200 miles south in Lower Saxony at either Celle or Wolfenbuttel.

    Both are Category A maximum security.

    Christian B has already spent time in Wolfenbuttel when he was on remand ahead of his trial last year for raping a 72-year-old woman in Praia da Luz in 2005 - just two years before Madeleine vanished.

    MAXIMUM SECURITY

    Judges at Germany's Federal court confirmed the sentence earlier this month and while on remand investigators used an informant to spy on him to gain evidence for their investigation into Madeleine's disappearance.

    The move will make it easier for prosecutors based at Braunsweig to question him in connection with the Madeleine case, and two other sex crimes they are trying to pin on him.
    Christian B was identified as the prime suspect in the Madeleine disappearance last June by German investigators.

    They said they had ''concrete evidence'' she was dead and that he was responsible, although no charges have been brought yet.

    'CONCRETE EVIDENCE'

    A source close to the case said: ''(Christian B) hasn't been questioned yet in connection with the Madeleine inquiry as the evidence is still being gathered and checked but the idea is to wait until he is closer to where the team are based.

    ''A 640km round trip (400 miles) every week would waste a lot of time and resources and now we know he will be in prison until 2026 we know where he is and we can get to him easier.

    ''The feeling is though he won't say anything even when we do see him but at least it will make it easier.''

    Prosecutor Hans Christian Wolters told The Sun: ''In Germany, the execution of sentences is basically the federal state in which the conviction took place.

    ''This also has cost reasons, because each federal state only wants to pay for the execution of sentences for which it is itself responsible.''

    Lawyer Friedrich Fulscher, who is defending him and insists the police have the wrong man, said: ''It's very likely he will be transferred in January but I have no comment to make.''

    2. I think OG is being distanced from Germany because CD knows it’s unlikely CB will be prosecuted by Germany. OG took down their appeal for info about CB and the phone calls a few weeks ago.
      OG prefer to follow the line of she may be alive because the search for a dead M would go nowhere and couldn’t justify OG continuing?
      Maybe CD doesn’t want the PJ to release any files on any work done. Which is what they might do once OG declares it has no further role.
      I doubt Portugal want to pursue this case and would declare their investigations have come to an end once OG says they are no longer investigating.
      Once we Brexit, I imagine we will have a less powerful influence in Portugal.
      The PJ won’t be interested in OG’s leads.

    A prosecutor who believes Madeleine McCann was killed by a German sex offender says the public would reach the same conclusion if they "knew the evidence we had".

    Hans Christian Wolters told the BBC that while his team does not currently have enough evidence to charge Christian B, he is "very confident".

    Their prime suspect is in prison serving sentences in Germany for drug smuggling and rape.

    Madeleine disappeared in 2007.

    She was on holiday with her family in Praia da Luz, Portugal, at the time of her disappearance, the same resort where Christian B raped a 72-year-old American woman.

    Suspects' surnames are not usually revealed in Germany for privacy reasons.

    Although Christian B, 43, was identified as a suspect in June prosecutors do not have enough evidence to charge him.

    Mr Wolters said: "If you knew the evidence we had you would come to the same conclusion as I do but I can't give you details because we don't want the accused to know what we have on him - these are tactical considerations."

    The six-month investigation has yielded fresh evidence of other alleged crimes.

    Christian B lived in Portugal on and off for years and investigators now believe he may have committed at least three other sex crimes here - two of them against children, Mr Wolters said.
    He said charges may follow early next year.

    Mr Wolters said progress in the case of Madeleine was slower because of the logistical challenges posed by a disappearance now 13 years old in a different country.

    But he said his team was working to build a water tight case against him.

    Christian B recently lost an appeal against his rape conviction and will remain in prison for a seven-year sentence once his current drugs sentence ends in January.

    Mr Wolters said: "I can't promise, I can't guarantee that we have enough to bring a charge but I'm very confident because what we have so far doesn't allow any other conclusion at all."

    Last week, Met Police commissioner Dame Cressida Dick said that the Met's position had not changed since the summer, when the force said its investigation - Operation Grange - remained a missing person inquiry as there is no "definitive evidence whether Madeleine is alive or dead".

    Madeleine, from Rothley in Leicestershire, went missing from a holiday apartment in Praia da Luz, on 3 May 2007, shortly before her fourth birthday.

    Christian B is currently serving a prison sentence for drug offences in Germany and lost an appeal last month against a further seven-year sentence for rape.

    He attacked the American woman in 2005 in the same area where Madeleine disappeared about 18 months later.

    Police believe he was regularly living in this part of Portugal between 1997 and 2007, staying in a camper van at the time he is suspected of abducting Madeleine.

    Drafting in foreign police to act as publicity officials for the prime suspects is a novel idea, and is providing amusement for people who have read this latest rubbish.

    However, the German police should note that the general public have no reason whatsoever to doubt the evidence in the PJ files. Most of which was provided by the McCanns and their friends during interviews. The German police may wish to read the PJ files before continuing to make fools of themselves.

    For instance, CB could not have had access to the McCanns hired car to transport Madeleine's frozen corpse without the McCanns and their friends knowing about it. (Evidence of Madeleine's bodily fluids were discovered in the car.)

    Therefore the German police have scored an own goal here. As this would firmly suggest the McCanns must have been in league with CB at some point after the death of Madeleine.

    Are the Germans playing slowly, slowly catchee monkeys here? If so, they should carry on. This can only assist in justice for Madeleine. Rest in peace.

      In the days when HTFM was at its peak, many people from across the country were linked, but we can’t recall the names from so long ago.

      Also, we have first-hand experience on how unreliable the source of information you mention is.

      It would have been easier to bring out the special table, as these function tables are very easy to assemble.

      Nowhere is it stated by the Tapas staff that a special table had to be ordered for the second time the group (said that) they ate there.

      Why would the Tapas bar already have a special large, round table-in-waiting when it was easier to link 2, 3 or whatever number would be needed of square tables together? Square tables, BTW, which are missing from Frog’s photo of the esplanade and are rather numerous in pictures in Amaral’s book.

    2. Ruth McClean was the neighbour of Brueckner who knew the American woman. Ruth was interviewed by Sandra Felgueiras.

      Ruth and her daughter said they hadn’t seen Brueckner or his camper van in the area, as he’d left the property some time ago. Ruth cleaned up the property after he left. She knew the American women, but hadn’t been told anything about the attack.

      The programme also showed documents that described the woman being assisted by neighbours, but Ruth obviously wasn’t one of them.

      There was a Peter K, an OC worker (PJ Files says in a handwritten comment that he was a cook at Tapas), with a surname that sounds German, who was under temporary leave from May 2 to May 10 for psychiatric reasons (also a handwritten comment).

      Surely more sensitive wording would have been used, something like nervous debility in an English sense according to Sue who is a working medic.

      I'll probably ask others when the opportunity presents itself, but psychiatric reasons, isn't that a tad nebulous or at least potentially harmful to someone in an employee/employer situation?

      That's non-specific and uses a word which could be potentially alarming to an employer and possibly detrimental to the employee.

      Who is Peter K with a surname that sounds German? Is he even real? You never know with that lot and their soap opera style fabrications. Gosh, it's like watching ye olde English children's TV shows all over again.

      They were fictional with an undercurrent of truth, in fact, pretty much the same template as this one.

      The only missing ingredient being Madeleine, who ironically, and one could say predictably, was never missing at all.

      And neither was Richard III.

      If we are to believe in that statement – we now know that the Ocean Club was very economical with the truth regarding Maddie – then Peter K was not present when the little girl disappeared.

      However, he was on duty up to May 1 which means he should have been questioned, as he could have seen something that would turn to be of interest in the preceding days.

      There is no statement from Peter K on the Files-

      We translated “Baixa Psiquiátrica” above as a “temporary leave for psychiatric reasons” when we it’s best translated as “psychiatric sick leave”.

      This sick leave is very easy to obtain in Portugal. It is not needed to be signed by a psychiatrist or a psychologist, being enough the signature of a GP.

      All one has to do is to go to a local GP, state that one is not feeling well, that one cannot cope with the work pressure at that moment and that one needs urgently to have a rest, that one gets such a sick leave.

      In terms of salary, the Social Security will pay that individual the salary during the period of the sick leave and the employer is exempt from paying the salary and taxes for that period. Please see para “2. Salary that is a salary and a half” of our post “Tourism diet”.

      Obviously, this facilitates fraudulent sick leaves, which unless there is a denunciation the system is unable to detect. If there is an agreement between the worker and the employer, then these fraudulent sick leaves simply go undetected. All is needed is to head to the nearest health facility, whine a bit and come back with a signed paper validating it.

      A fraudulent psychiatric sick leave would be a very easy go-to mechanism to “avoid” the presence of someone during both when occurrences happened and the period to be questioned by the police who would refuse to go along in telling lies that others had no problems in telling.

      Isn’t it fascinating that on May 8, a Mill worker knows about a psychiatric sick leave from someone who works at Tapas? Did all Ocean Club workers follow each other’s presence at work even though the Ocean Club has a footprint in so many locations all over Praia da Luz?

      We have said that there we believe that there is unpublished material – an example we gave was what Mrs Fenn said on the night of May 3 or on May 4 – which the PJ considered to NOT HAVE IMPORTANCE to be presented for decision from the higher echelon, and so was not included in the files.

      Shall we say that it’s the Recycle Bin of the process that hasn’t been emptied out yet.

      Taking into account that we have a lot of meaningless statements from the OC staff we assume that Peter K was not questioned. However, we do not discard that his statement may be in the said bin. If it is, then it’s because he had nothing to say the PJ considered relevant and not because he said anything sensitive/secretive.

      For any document to be retrieved from that bin and to be included in the ongoing investigation there has to be a RELEVANT reason, which must be given and put in the process so that the decider can fully understand why it wasn’t included in the initial process and now it has become relevant.

    In the truest most literal sense of the word, Madeleine was not disposed of. She died, for sure she passed away, but she WAS NOT DISPOSED OF.

    Go to ground zero, for even Occam's cat would have started the filter and discard process at the beginning.

    The Ocean Club disposal unit would have been full of superfluous junk.

  47. As a seemingly cunning back-up plan to Brueckner being the perpetrator of an abduction, Martin Ney is back in the picture. Ney is serving a life sentence in Germany for 3 child murders and 40 sexual assaults. He was named as a suspect by the McCanns’ private investigators in 2011; presumably the questionable Metodo 3, who were still employed by them in 2011.

    Ney was extradited to France on January 22nd , for questioning over the murder of 10 year old Jonathan Coulom in 2004. The French authorities have been given 8 months to carry out the investigation. The TV station RTL claimed Ney would also be interviewed by Scotland Yard.

    According to the Star on January 24th, Ney was quizzed earlier by the police after his resemblance to the sketch of a prowler outside the McCann apartment. Ney is reported to have visited Portugal at some point in the 1990s and early 2000s, but in 2007, he was living in Hamburg, where he was employed as a youth worker with Evangelischen Jugendhilfe Friedenshort. Presumably, they have records of his work with them in May 2007. As in the case of Brueckner, Ney is alleged to have made a confession to a cellmate.

    The UK police have not requested the extradition of Brueckner to the UK for questioning and may have missed any opportunity to do so, as the UK is no longer a member of the EU. As far as we know, he still hasn’t been questioned by the German authorities.

    According to the Mirror, the German and Portuguese investigators will carry out new interviews in the Algarve and a summit of German, Portuguese and British detectives will take place in Lisbon in the spring. Witnesses have been put on standby.

    This is where it starts to get more interesting.

    According to an article written in 2019, by Martin Fricker, Ney was in Portugal at the time of M’s disappearance and a former resort worker claimed they saw Ney in Praia da Luz before Maddie disappeared, staring intently at them as they drank in an Algarve bar. (“them” seems to be a way of avoiding saying whether this person is male or female, rather than meaning more than one person) This person claimed to recognise Ney after seeing his photo in the Sun newspaper. Ney was there “for a fact”.

    The ex -Mark Warner employee saw Ney shortly after arriving in PdL in April 2007 and at the Baptista supermarket, saying “I have a good memory for faces”. The witness was later moved to another resort in Greece. The report concludes with the fact that Scotland Yard had spoken to their German counterparts several years ago and ruled out the involvement of Ney as he was only interested in young boys.

    From this report, it can be deduced that the witness was a nanny, as some nanny staff were reportedly moved to Greece. This is confirmed by another article by Fricker and co., written on June 6th 2020, when he reports that a” Resort nanny quizzed by the police over a new suspect, 5 days after M disappeared”.

    Here, the suspect is Brueckner, not Ney.

    “A nanny who looked after M was shown a picture of a German paedophile, she was told his name on May 8th 2007 at the McCanns’ holiday apartment… She was shown an identikit on the day after they took my statement”. Assuming this is the order of events - May 6th, nanny makes her statement (where there is no reference to photos or identikits, as with all the nannies) May 7 nanny is shown an identikit, May 8th, nanny is told his name, at the apartment.

    If this is the order of events, the nanny is likely to be Cat Baker, who made her statement on May 6th, 2007, translated by Robert Murat. However, in her rogatory interview in 2008, no mention is made of names or identikits and she says she never noticed anyone suspicious. She does confirm that she had been in Portugal since March 21st 2007, which may be consistent with the unnamed ex Mark warner employee who had seen Ney shortly after arriving in PdL, in April 2007. Depending on whether she means she saw him in April, shortly after SHE had arrived in PdL (on March 21st).

    Cat Baker had visited the McCanns at their home in November 2007, before her rogatory interview. If she was the nanny concerned, did she mention the identikit and name to them?

    Could Cat Baker also be the anonymous Mark Warner employee who we deduced to have been a nanny and who claimed to have seen Ney in Praia da Luz, in the Baptista supermarket?

    Or were there 2 nannies who independently claim to have seen Ney and Brueckner respectively? Her/ their identities are known to Fricker, so he may be able to assist regarding any witnesses who are on standby to be interviewed.

    It would be remarkable if both of these notorious individuals, Ney and Brueckner had been in the area at the same time, along with the deceased Euclides Monteiro, whose phone signal was also said to have placed him in the same area that night.

    1. We find it extremely difficult to believe an ECHR spokesman has discussed the progress of a case with the press.

      Its own website has a question and answer information sheet for applicants:
      “How can I obtain information on a case?”
      “The court cannot answer all the requests it receives for information about the progress of cases pending before it.”

      Applicants can go online for cases pending and check the present state of proceedings in the case, as described in the article.

      Before the case is communicated to the state of Portugal, it has to be ruled as admissable.

      The article has put words into the mouth of the “spokesman” as the spokesman here is declaring that the first stage of being ruled admissible has already taken place and the next stage is communicating to the state but the article then goes on to describe the correct process and the current state of the application, which shows ADMISSIBILITY HAS NOT YET BEEN DECIDED.

      All that is shown on the present application is that if has met the requirements on the application form for it to be considered by the ECHR.

      So why are we being fed false information about a decision by spring?

      And why would be (are, according to the rag) the McCanns able to obtain information that isn’t available other applicants?

      Lastly, we find it fascinating and deeply troubling that even though the media is witnessing the damage society – and itself as well – as suffered as result of the continued perseverance in pushing obvious lies – or the true peddling of fake news – the British tabloids insist on the same formula.

    The Smith family was the one contacting the authorities upon seeing on TV the image of Gerry McCann walking down the stairs of the plane on their return to England. That image apparently jolted the memory of the family regarding the man they saw with a girl on his arms in the Rua da Escola Primária on the night of May 3.

    Martin Smith contacted DC John Hughes of Leicester Police on 20 September 2007.

    Pages 4134-4139 name Detective Liam Hogan from Drogheda. Dated 30th January 2008. Hogan described Smith as a genuine person who was known locally.

    From our own knowledge of Mr Smith’s address in Drogheda, he was living there before 2007 as there is a media article about his family.

    We are not giving a link for this as it gives family details about a daughter who had no involvement in this case.

    The McCann/Healy application was received by the ECHR in July 2017 and acknowledged on August 8 2017.

    No further action has been recorded on the site since this date.

    McCann Healy case was communicated to the State of Portugal on 14/1/2021.

    Importance level 3. ECHR level 3 case: “Low importance- judgements, decisions and advisory opinions of little legal interest... simply applying existing case-law, friendly settlements and strike outs...”

    Article 6 6-2 - Right to a fair trial

    Article 8 8-1 – Right to respect for private and family life.

    Seems the McCanns have made their case stick at the ECHR.

    As far as we know, this means Portugal are asked to respond in some way but not to dispute the court findings.

    We think these may only be published when Portugal has responded, as the next step could be a friendly settlement or if not, a publication of the judgement on the ECHR website.

    So, it seems isn’t about the urgency of a case but whether it would mean certain legal issues were involved. They may be of low legal significance in that it applies existing legislation/law rather than a challenge to the legislation.

    State can respond and it seems as if the response can have some influence as to how the application proceeds.

    As a written document will eventually be available, we’ll eventually find out.
    Initially, friendly settlement procedure is confidential, but I don’t know whether that means it won’t appear on ECHR website, or whether the details won’t be outlined but the fact of a FS being reached would be.

  55. In the communicated case to the State of Portugal, 2 questions were posed to the parties.
    Article 6 6-2 - Right to a fair trial-
    Article 8 8-1 – Right to respect for private and family life.

    We’ll begin to address the second question, regarding Article 6 6-2 - Right to a fair trial: “Has the presumption of innocence guaranteed by Article 6-2 of the Convention been respected in the present case having regard to the reasoning contained in the decisions handed down on 31 January and 21 March by the Supreme Court (see, Allen v. The United Kingdom no 25424/09- 94 ECHR 2013)?”

    The case referred to was brought by a woman who served 3 years imprisonment for the manslaughter of her baby son. She did not appeal her sentence at the time.

    Following her release, certain facts (regarding shaken baby syndrome) came to light which rendered her original conviction unsafe but no re-trial was ordered. Her original conviction was quashed.

    She took her case for miscarriage of justice through the U.K. courts, with a claim for compensation but was unsuccessful.

    Her case in the ECHR was heard by a panel of judges of the Grand Chamber.

    The issue of presumption of innocence was considered by the Grand Chamber as part of their deliberations.

    The case was communicated to the UK, who contested the application.

    The ECHR did not find in her favour.

    The case referred to is in no way similar in its details to the case brought by McCann/Healy, but the Portuguese state is being asked to respond to the reasoning contained in the Allen case with regard to the presumption of innocence guaranteed by Article 6-2 of the Convention as it applies to this case.

    As we are not qualified to interpret a legal document, we won’t attempt to summarise the reasoning in this lengthy and densely argued case of Allen and suggest readers read it for themselves and check if our summary adequately reflects the very basic facts of the case.

    However, it does show that the communication of the case to Portugal does not guarantee that the McCann/ Healy case will prevail in its arguments.

    We will look at question 1 about the applicants’ rights to respect for their private life, in relation to GA’s book and documentary, at a later date, as a number of previous cases are quoted which will take some time to read.

    Portugal is asked if their domestic courts adequately balanced respect to private life of the parties and the rights of their opponents to freedom of expression.

Having read the ECHR press release on the case against the State of Spain, it’s not clear to us why this case is quoted in the Questions to the Parties 1, as the press release relates to the presumption of innocence under Article 6 section 2, whereas the questions relate to applicants respect for private life Article 8 section 1 of the Convention.

    Reading the case in full from the Polish translation of the ECHR ruling doesn’t clarify anything for us.

    The wording which could be significant to the ref to Amaral is the applicants’ argument that exclusion (from compensation) “could only be based on a criminal conviction and not on mere suspicions in police reports.”

    The police reports “which indicated that the applicants’ relatives had been members of the ETA terrorist organisation. These reports referred to different sources (statements made by other ETA members, press articles and publications related to ETA).”

    As already stated, we are not legally qualified to interpret these documents, so this is only an observation.

    Th Von Hannover case concerns publication in the press of photographs of the royal family of Monaco and sets out the criteria to be followed when balancing the right to privacy - Article 8 against the right to freedom of expression Article 10, which is exactly what the Lisbon trial was only about.

    In the case of Axel Springer, parent company of German newspaper Bild, the ECHR found in favour of Axel Springer by a majority.

    The case concerned popular actor X, who was reported in an article as having taken cocaine.

    The court balanced freedom of expression and privacy and established 5 criteria in their judgement.

    The criteria included how well known the person is, the prior conduct of the person concerned and the content, form and consequences of publication.

  61. We would like to remind our readers that the Portuguese Supreme Court referred to many examples of ECHR case law in its judgement, including the case of Allen v UK 2013. See pages 12 and 68 of the SCJ judgement.

    The PSC did not refer to the cases of Axel Springer and Von Hannover 2012, or Bedat 2016.

    The case of Larranaga 2019 was after the PSC in 2017.

    As they were responsible for setting Germany off in pursuit of Brueckner, after the interview of the criminal Helge Busching in the Athens hotel, by OG detective Mark and colleague, they can share the blame with Germany when this goes nowhere.

    We’re still hoping it will result in the prosecution of Brueckner, to open the facts of the Maddie case to the fresh air of re-investigation.

    This blog article from 2017 deals with the right of presumption of innocence; one of the issues now before the ECHR, the other being respect for private life.

    The jurist commenting here clarifies the contradictions and confusion contained in the Archiving Despatch, between Articles 277-1 and 277-2 of the Code of Criminal Procedure and the reliance of the McCanns on 277-1.

    They claim under 277-1 they were found not to be those who committed the crime and were therefore exonerated, rather than 277-2, which is based on insufficiency of evidence, which the Supreme Court says does not equate to a declaration of innocence.

    The opinion of the jurist is that the McCanns’ application for annulment of the SCJ ruling was more than a dilatory strategy and was to enable them to have an argument to proceed with a complaint to the ECHR.

    The application for annulment was unsuccessful, as the jurist predicted.

  67. A clarification regarding the ECHR and Questions to the parties 1 and 2.

    The questions referring to cases already adjudicated on by the ECHR are questions posed by the ECHR to both parties; the McCanns and the State of Portugal.

    Allen v the UK 2013 was referenced by the Portuguese Supreme Court, so it may be that the McCanns did not use it to support their application and are now being requested to do so.

    We know the other cases were not referenced by the PSCJ but the cases referenced in the McCann application are unknown.

      This case, one of several referenced by the ECHR in its questions to the parties, seems, from our perspective of laypersons, to be the only one which may support the McCanns’ application in some, but not all respects; in that the ECHR found in favour of the State of Switzerland and against the applicant’s case for freedom of expression.

      As we’ve already said, this case involved a case in the court process, whereas the McCanns were never brought before a criminal court.

      It also involves information obtained illicitly (rather than illegally), whereas the information used by Amaral was already in the public domain.

    We think this is the most relevant document.

    This is the stage the McCann case has reached - the non-contentious stage.

    It is likely the Portuguese State has responded within the 12-week period, to the case law examples referenced by the ECHR in January.

    Under Friendly Settlements para 2, a declaration can be sent to the parties.

    Alternatively, no declaration is sent and both parties have 12 weeks to indicate their position regarding a FS.

    The contentious phase only begins if the parties cannot reach agreement.

    IF a declaration has been sent, the terms of the declaration are set by the ECHR, which suggests to us that the court would have made its position on the application clear to both sides.

    Both sides then have 12 weeks to respond.

    FS procedures are being increasingly used by the ECHR to deal with the backlog of cases and are used when cases involve well established case law.

    Some seem not to understand the ECHR as they are stating the court wouldn’t propose friendly settlements, but then again, these people in the past had no qualms whatsoever to state absurdities as facts of the case.

    The law blog considers the negative aspects of FS compared to procedures prior to 2018. The McCanns made their application in 2017.

    Prior to 2018, the ECHR simply informed the parties of the possibility of concluding with a FS and only put forward specific proposals in a limited category of cases.

    Cases seen so far under the new procedures by the writer Jessica Gavron merely consisted of ex -gratia payments with no acknowledgment by the State of any violations.

    The writer considers that an offer of a FS from the court to be an “inescapable signal sent to the applicant is that the court considers the case not to warrant further consideration; that the payment is not required to be in recognition of any violations and that no non- monetary provisions, such as undertakings to investigate, are required”

    The case could be struck out if the applicants decline a FS.

    Both situations referred to, with big IFs, suggest the McCanns, IF they are offered a FS, have to consider the implications of not being able to pursue any further claims and the possibility of the State not being required to acknowledge any violations have occurred.

    It may be that their case will move from the compulsory (as stated here) non- contentious stage to the contentious stage, if both parties fail to agree to a FS.

    1. Personally, I can't see a FS being made by either party, not when both sides believe they are 100% correct and want to prove the other side wrong.

      They'll try to make Senior Amaral look like a fool first and then attempt to do the same thing last as well, in my view of course.

      One of the major problems, it seems, is that neither side can actually prove what they have claimed, abduction or death in the apartment.

      There's nothing solid enough either way, not unless someone decides they've had enough, uses their brain and opens their mouth.

      John M, the former MP, has taken court action against SP for falsely accusing him of child abuse.
      Darren L has also taken court action for similar allegations against him, which is at the pre-hearing stage. I also understand certain allegations made against him resulted in him being arrested but not subsequently charged. as a result of those allegations and that
      SP had to disclose the names of others involved with her in the case of Darren L.
      As far as I’m aware, John M has an unblemished record and Darren L has a previous conviction unrelated to child abuse, as reported in the press.

    If a friendly settlement is agreed, it is published on the website and it can take 2 weeks before it appears.

    If a friendly settlement has not been agreed, a further 12 weeks is given for the contentious stage.

    Judge Recorder Taryn Turner said: “I will say from the outset of the most despicable treachery and wickedness and will send a chill to the heart of many who are encouraged to entrust the running of their financial affairs to their friends, family or supporters, as they themselves face the decline in health and mobility as they grow older.”

    Teesside Crown Court heard how Sanders emptied more than £80,000 from the pensioner’s accounts as well as securing loans in her aunt’s name bringing the total deception to £122,000.

    The judge added: “This was a sinister, callous and wicked deceit because behind your aunt’s back, over a period of four years, you systematically abused the trust and faith your aunt put in you in order to clean out her bank accounts.

    “Taking something in excess of £122,000 but worse still were the steps you took to cover the tracks of your dishonesty. You used a computer to manufacture false bank statements that you could then show to your aunt to convince her that her finances were in a healthy state - when plainly they were not.”

    The 63-year-old former NHS worker had pleaded guilty to three charges, including fraud by abuse of position, fraud by false representation and making articles for use in fraud.

    The court had heard how the defendant had initially borrowed some of her aunt’s money when she was suffering financial difficulties but failed to repay any of the cash, instead spending it on holidays and designer goods. The judge praised the victim’s bank for reimbursing all of the money that had been drained from the victim’s accounts.

    Sanders, formerly of St Johns Garth, Thirsk, was also made the subject of an indefinite restraining order.

      A WOMAN who fleeced her frail, elderly aunt out of more than £100,00 has been warned she is facing custody after leaving the vulnerable pensioner virtually penniless.

      Karen Sanders emptied the bank accounts of the victim, who is in her 80s, over a four year period after she was made power of attorney over her aunt's financial affairs.

      The 63-year-old is accused of using the money to fund her lavish lifestyle, including buying designer clothes, watches and handbags, as she relentlessly drained her aunt of all of her financial assets.

      Teesside Crown Court heard how Sanders would do the pensioner's shopping whilst also dipping into the victim's savings for herself.

      Ian West, prosecuting, said the defendant was 'more than likely' to be the soul beneficiary of her aunt's estate when she died.

      He said: "The defendant, in order to cover her tracks, used a computer to manufacture false bank statements which she would show to her aunt to convince her that her accounts were in a healthy state.

      "Whereas when the fraud was discovered in 2019 they had been pretty much stripped bare.

      "The defendant, it seems, spent the money on the high life style."

      Police seized dozens of expensive designer handbags, shoes, jewellery and sunglasses when her house was searched.

      Mr West said the victim described Sanders as her 'one and only niece' and she has 'betrayed me in the most dreadful manner'.

      The court heard how the victim was left £2,000 overdrawn when Sanders' offending came to light – leaving the pensioner out of pocket by £122,000.

      Mr West said the stolen money was replaced by the victim's bank but the impact of the deception had had a traumatic affect on the pensioner.

      Sanders, formerly of St Johns Garth, Thirsk, pleaded guilty to three charges, including fraud by abuse of position, fraud by false representation and making articles for use in fraud.

      Kelleigh Lodge, in mitigation, said her client had initially borrowed some of the money to help her out when she hit financial difficulties but accepts she never paid the money back.

      She said: "She did plead guilty at the lower court and when interview by police she made admissions and gave a detailed account of her offending."

      Sanders will be sentenced this morning.

      "I don't know how long I live and I don't know what the future is going to hold and I think that is the worst of all – wondering about the house and its contents because I love it.

    Isn't that so interesting? Why did the judge consider this necessary?

    One can only presume the judge perceived possible risk of repetition of certain actions. An evident pattern in the character of the condemned criminal, we would say.

  84. Under the section Proceedings, the ECHR may decide that the observations by the State and the friendly settlement proceedings can occur at the same time.

    How that works in practice with the different timescales isn’t made clear.

    Doug D, in another forum, has estimated the timescale for a response as May 6th and he may be correct if the State make use of the full 16 weeks given for their response.

    If the Friendly Settlement procedure is running in parallel, then the time scale is 12 weeks for the non-contentious stage, followed by another 12 weeks for the contentious stage, as from January 14th.

    If nothing appears on the court website in the next couple of weeks, it may indicate that there has been no agreement.

    This is the second time a member of the Lick-Spittle gang has been caught scamming.

    The other time was Zora with her We’restarvingfraudFund (to be clear, quoting from the text used in the Fund, “Some nights she [the mum, Zora] has gone without dinner so that us kids could eat”).

    Now, KLS has stolen the life-savings from her elderly aunt to buy expensive handbags among other things, while then Zora took the money from, among others, this particular contribution of a 14 yr old girl to spend by going to watch a concert among other things:

    We are certain that those £5 represented a lot to that young teenager with a heart of gold a lot. And we sincerely hope that she never got to find out how she was scammed out of them.

    When this scam was exposed, the gang used the minor in whose name the GoFraud text was signed as a shield to twist the disgraceful and evident reality that a scam had taken place and that money had been taken from people with good hearts who were duped into contributing.

    It’s irrelevant as to who really wrote those words – some who know Zora very well assure us that it was Zora herself and not the minor writing them. One has to be over 16 to set up a GoFundMe account unless an adult is involved in setting it up. So it couldn’t be done without the adult’s knowledge or consent. Zora would later recognise she was fully in agreement with it all.

    As the reader can see, this is a very good example of psychological projection regarding the GoFraud scam as it projects the feelings of the gang in relation to the minor they used as a shield.

    One just has to replace “Karen’s aunt” for “the minor” and the statement becomes 100% accurate: The gang couldn't give a toss about the minor, they used the minor to troll us whilst trying, but failing to take the moral high ground…

    We haven’t seen a single word of condemnation of this by the gang and 2 people liked this tweet.

    And talking about condemning or not abhorrent behaviour, we have not seen a single member of the gang condemning KLS in clear terms. The best we have had was Jules saying “What Karen has done is wrong on every level, but…”

    Some claim KLS they don’t condone what she did. The fact they implicitly expect that we would expect them condoning a crime says more about them than about us. Of course no one condones, but any decent human being should condemn categorically and without hesitation the ripping off of the life-savings of an elderly relative as they should have condemned the taking of money from good-hearted people, including the pocket-money of a teen girl which none did in both cases.

    Frog equates KLS to Gonçalo Amaral. We don’t think we need to say anything more about this pathetic comparison.

    But there is something similar between KLS and Gonçalo Amaral and that is that they have both faced justice in the appropriate place to face it: their respective country’s judicial system. One is in prison, the other is not.

    KLS is now paying the price for her actions, so we think people should refrain from saying anything further about her. If she resumes her previous behaviour, that’s another totally different scenario.

    Also, taking into account that apparently the police seized KLS’ computer and phone equipment, if any news comes out of this, we will obviously comment.

    We all have our particular stories, successes and failures, things we are proud of and things we are ashamed of in our lives but the knowledge that we are on the opposite side of the fence of Jules, KLS, Frog, Walker, Zora, BenT and the rest of the Lick Spittle gang is a balm for the mind because it means we continue have values, empathy and souls, a true badge of honour to be worn with pride.

  91. Nobody has as many suicidal friends as Ben Thompson. If they didn’t stalk people and threaten them with violence or commit fraud, they wouldn’t be suicidal. When Erica Jane and Shell told lies to the police to have Debbie and Elaine arrested, some of the gang were bound to feel suicidal. Because they are scared of being investigated by the police and ending up where Karen is.

    They also know the consequences for telling lies about Anvil being on the sex register for paedophilia and accusing Elaine of stalking a child. Why has Zora McCartney still not reported Elaine to the police? Is she afraid their point of view would be that Elaine had protected the child by exposing the gofundme (which the child was not old enough to have) and that they would have to refer Zora to social services for having enabled her child to beg for money on the internet, because she could not afford food and rent for her family?

  92. Not sure if you're aware or not but today was the Sonia Poulton court case regarding her YouTube video Paedophiles in Parliament. I don't want to mention the former MPs name as people can look it up. She is claiming her work was highly researched.

    I for one, beg to differ. Her Twitter followers, on the other hand, are right behind her and believe what she says is the truth. Her research methods are for the birds IMHO, and she's spread more harm than good, plus, she never did understand the Maddie affair.

    She dangled the inducement carrot and came up with nada. No matter, let them pay her extravagant lawyer's fees and lifestyle bills if they need to believe her research that badly. That way, their questions will always go unanswered.

It was mentioned that he has friends who say they are suicidal, not that he had friends in his past who committed suicide. The only reason his friends have threatened to take their own lives, is because they know what the police will find if they are investigated.

    Elaine Strachan was named - along with other sick trolls, in a #suicide note left by a friend of mine. She was named because she and her friends trolled and bullied my friend to such a degree that they felt the only option was to take their own life.

To their friend in prison, so they can buy luxuries like food and toilet rolls, or should it be returned to the old aunty?     Reason for censoring: it involved details about KLS’ personal life and lifestyle. As the blog has stated, KLS has been made accountable for her actions by the justice system and the punishment is by paying the price that same system has determined as appropriate.

    German police seem to have found that Brueckner did not rent the cellars which they recently searched in Germany, at the time Maddie disappeared. They dug the properties in vain and now look stupid.

    It’s usual for German allotments to have cellars, which are not “hidden lairs” as the press claimed. They are cold storage areas for produce.

    The only difference we see between Barkas and Brueckner is that now the German police has put its chips on the German patsy. We will see how relevant that will be.

      Train Covid dogs to also to alert to Malaria but make sure they are known publicly ONLY as the Covid dogs.

      Keep the Malaria alerting thing to be like a “professional secret”, for example by not alerting to that fact before each search. That way, one won’t spoil the fun of letting a patient believe that he has Covid although the alert wouldn’t mean that!

      Also, train other dogs to only to alert to Malaria. That way one can fill one’s mouth with having them “working in tandem” which although it only means working together for a same objective, sounds cool and gives an aura of having “professional secret” knowledge that the rest of humanity doesn’t have.

      To each alert by the Covid (& Malaria) dog, bring in a Malaria dog. If it alerts, it’s only Malaria. No, because it could be both Covid and Malaria. If it doesn’t, then it has to be Covid unless it’s a false negative for Malaria.

      All very simple. And objective.

      What is wrong with this reasoning? Did the reader spot it?

      If one trains Covid dogs to alert also to Malaria then why train Malaria dogs only to Malaria? Train them to Paludism as well! That way an alert by the Covid (& Malaria) dog together with an alert by the Malaria (& Paludism) dog means that the patient may have Covid, Malaria and Paludism! That’s a whole new level of panic.

      And while the reader thinks of how absurd this is, this is what BenT, NotTextusa, JBLittlemore, Jules and the other gang minion parrots defend regarding the dogs used in the Maddie case.

    Kate and Gerry McCann are still facing legal costs to fight sickening claims by a Portuguese detective that they were responsible for their daughter Maddie's death, MailOnline has learned.

    New documents reveal they face ongoing expenses as part of their long running libel action against the police officer who investigated the disappearance of Maddie, 14 years ago this month.

    In a 2008 book Portuguese detective Goncalo Amaral claimed Kate and Gerry accidentally killed Maddie and covered it up by pretending she had been abducted.

    The couple won an initial libel claim challenging his outrageous claim, but the policeman overturned the decision and it was also upheld by another court.

    Two years ago court files showed the couple had had to fork out £29,500 on legal fees for Amaral. Since then they have had to pay out a further £4,229 in legal costs making a total of nearly £34,000.

    The European Court of Human Rights is due to rule on a further legal appeal shortly and if the McCanns lose the right to appeal they will have to pay still further court costs to Amaral.

    The latest payout is detailed in accounts for the company, Madeleine's Fund: Leaving No Stone Unturned Limited, which is funding the search for the couple's daughter aged three who disappeared on May 3, 2007.

    Paperwork says: 'Legal costs of £4,229 were reimbursed to the directors, Gerald and Kate McCann in relation to ongoing libel action in Portugal.'

    1. The Mail article is incorrect. The ECHR application is nothing to do with libel, nor is it an appeal.

      It’s an application by the McCanns against the state of Portugal for alleged violations regarding their rights to private and family life and the presumption of innocence.

      Is this article preparing the public for news that the McCanns are about to lose their case?

      Their case was notified to Portugal on January 14 2021, with 16 weeks for the state to respond to a number of case examples quoted by the ECHR. That date would be June 6, if Portugal used the full period allowed.

      Since January 2019 it is routine for the parties to be asked to consider a Friendly Settlement (FS) procedure. It’s not “ an extraordinary request” as claimed by a friend of the McCanns in March.

      This can be divided into a non- contentious and a contentious stage, each lasting 12 weeks. The first stage is confidential and without prejudice.

      Alternatively, it can be a single phase procedure where admissibility and merits are examined at the same time and the applicants are asked to respond to the government observations within 6 weeks.

      We think the latter procedure may have been used in this case because it does not require new case law to be applied. We think this because the ECHR stated in January that it was only a case of importance level 3. This means of low importance in that existing case law can be applied.

      The court can make its own proposals for a FS to both parties when the single stage procedure is used.

      The parties then have 6 weeks to respond.

      The state may accept the FS proposal made by the ECHR, which states that this does not indicate that a violation may have occurred. The state may offer financial recompense without accepting any violations occurred.

      If the state offers a FS and the applicants refuse it, the state can make a Unilateral Declaration, which the applicants do not have to agree to.

      Usually the state accepts violations have occurred and offers financial recompense, but if the ECHR proposal does not include recognition of violations, presumably a Unilateral Declaration would reflect this?

      On March 27, according to the Sun, the McCanns received a “legal blow” when they were “told” to accept a Friendly Settlement.

      This made us wonder if Portugal had responded earlier than 16 weeks to the cases quoted, defending the decision of the Supreme Court, but also offering a FS which did not accept violations, although still offering some recompense? Let’s say, for example, by covering the court costs incurred by the McCanns.

      This would present a dilemma? Take the recompense without receiving any acknowledgment that any human rights had been breached or risk the state making a Unilateral Declaration.

      If the single stage procedure has been adopted, we would expect any FS agreed to be made before the end of June.

      If the two stage procedure of 24 weeks has been adopted, dating from January 14, then it would be a later date, depending on when exactly the parties respond in the timescales given and whether it moves to the contested stage.

      If the ECR have made a FS proposal, that would seem indicative of their thinking and either party wishing to enter the contentious stage suggests they feel the FS proposal is in their favour.

      All of this is speculation and not a legal interpretation of events.

    MADELEINE McCann's parents have been told they will find out this year if they have won their legal battle against ex-cop Goncalo Amaral.

    Kate and Gerry took action against Amaral, 61, for his slurs in book The Truth of the Lie.

    He claimed the devastated couple were responsible for Madeleine’s disappearance in 2007.

    The pair initially took the case to court in ¬Portugal and won, but then lost an appeal.

    They lodged a fresh case at the European Court of Human Rights in 2017.

    ECHR judges wrote to the Portuguese government and the McCanns asking for “observations” and if they would consider settling out of court.

    The McCann legal team said they were willing to settle but Portugal refused their offer.

    The judges will now give a verdict by the end of the year.

      We are reminded of the time when Gonçalo Amaral refused to settle outside the court.

      It’s from Nick Pisa, so the usual lies were expected. The legal battle in question is not against Amaral as stated but against the state of Portugal. Amaral has literally nothing to do with this however many times his name is mentioned both in and outside the process.

      Another lie, is to say they lost an appeal. No, they lost 2 of them, the last defeat being against the highest court in the country.

      This article says it will be settled this year but our information is first semester of next year. Obviously, we trust way more our source.
